HomeMy WebLinkAbout20210901Intervention_Order_No_35155.pdfORDER NO. 35155 1 Office of the Secretary Service Date September 1, 2021 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION On August 18, 2021, ABC Power Company LLC (“ABC Power”), Comet Energy LLC (“Comet Energy”), Richard E. Kluckhohn, pro se and Wesley A. Kluckhohn, pro se (collectively “Kluckhohns, pro se”), and Idahome Solar LLC (“Idahome Solar”) filed petitions to intervene. All petitions were made pursuant to Rules of Procedure 71 through 75 of the Idaho Public Utilities Commission, IDAPA 31.01.01.071-.075. FINDINGS OF FACT Commission Order No. 35121 set an August 17, 2021, deadline for petitions to intervene. ABC Power, Comet Energy, Kluckhohns, pro se, and Idahome Solar filed petitions to intervene on August 18, 2021. However, it was discovered that when persons inquired of the Commission about the intervention deadline, they were told that the deadline was August 18, 2021. Based on our history of liberally allowing intervention in order to promote participation in cases before the Commission, and in light of the information provided by the Commission, these petitions are deemed timely. We also find that no party timely opposed these Petitions to Intervene. We thus find it reasonable to grant ABC Power, Comet Energy, Kluckhohns, pro se, and Idahome Solar’s petitions to intervene. O R D E R IT IS THEREFORE ORDERED that the Petition to Intervene filed by ABC Power is hereby granted. IT IS THEREFORE ORDERED that the Petition to Intervene filed by Comet Energy is hereby granted. IT IS THEREFORE ORDERED that the Petition to Intervene filed by the Kluckhohns, pro se, is hereby granted. IT IS FURTHER ORDERED that all Intervenors comply with all rules of the Commission including Rules of Procedure 71 through 75, and 222 through 223 of the Idaho Public Utilities Commission, IDAPA 31.01.01.071-.075, .222-.223. IT IS FURTHER ORDERED that all parties in this proceeding serve all papers hereafter filed in this matter on all parties of record.
