MOTION Idaho Power Company ("!daho Powe/'or "Company"), in accordance with RP 56 and 256 hereby respectfully moves the ldaho Public Utility Commission ("!PUC' or "Commission") for leave to file an Amended Application in this mafter. This matter was fully submitted to the Commission for its deliberation on October 12, 2021, however, a final order has not yet been issued. Because the record is currently closed, and because the facts and circumstances, and timing, of the first capacity deficit to be used for avoided cost pricing have substantially changed during the pendency of this case, ldaho Power respectfully requests leave of the Commission to Amend the Application, and initiate additional proceeding to consider ldaho Powe/s proposed amended first capacity deficit of July 2023. ldaho Power respectfully submits herewith its Amended Application, which seeks to implement a first capacity deficit of July 2023. IDAHO POWER COMPANY'S MOTION AND AMENDED APPLICATION . 1 II. BACKGROUND The originalApplication in this matter, Case No. !PC-E-21-09, was filed by ldaho Power on April 9, 2021. The Application was made after the Commission's acknowledgment of the Company's Second Amended 2019 lntegrated Resource Plan ('lRP"), and pursuant to Order No. 34649, Case No. !PC-E-19-20.1 The lndustrial Customers of ldaho Power ("lClP') and the ldaho Hydroelectric Power Producers Trust ("ldaHydro") were granted intervention on June 23,2021. Order No. 35084. Commission Staff ("Staff') and ldaHydro filed Comments on July 21 ,2021. lClP did not file Comments. ldaho Power filed Reply Comments on July 28,2021, agreeing and accepting Staffs recommended changes and adjustments to the capacity deficiency determination. The Case appeared as a "fully submitted" matter on the Commission's October 12, 2021, Decision Meeting, where the Commission determined that the matter was fully submitted and would be deliberated privately.2 ldaHydro requested in its July 21,2021, Comments, 'that the capacity deficiency date for PURPA QF avoided costs be set at a mid-summer month in 2023." ldaHydro Comments, p 2. ldaHydro refers to the Company's Notice of lntent to seek requests for proposals that references a capacity need identified as early as Summer 2023 and asks the Commission to establish the same for PURPA avoided costs. ld., atp 1-2. Staff issued several discovery requests and filed Comments recommending that the Company update the first capacity deficit from that contained in the acknowledged I Order No. 34649 dismissed ldaho Powe/s previously filed Application for approval of the capacity deficiency to be utilized for avoided cost calculations that was made at the time of filing of the 2019 IRP and directed the Company to make the filing after Commission acknowledgment of the lRP. 2 ldaho Public Utilities Commission Minutes of Decision Meeting, October 12,2021, 1:30 p.m. https://ouc.idaho.qov/Fileroom/PublicFiles/Aoenda?2021?2021 1013MlN.pdf IDAHO POWER COMPANY'S MOTION AND AMENDED APPLICATION.2 Second Amended 2019 !RP, which was that contained in the Company's Application, by incorporating severa! updates and changes. Staff Comments, p 1-2, 10. Staff also recommended that the Commission open a generic docket to determine the timing of the deficiency date filing in relation to the timing of the lRP, 'r.e., after the filing of an lRP, after the acknowledgment of an lRP, or at other times." /d. at p 10. !n its Reply Comments ldaho Power acknowledged, 'an apparent difference between the first capacity deficit that appears in the acknowledged 2019 Amended IRP (2028) and that which is referenced in the Company's Notice of lntent to seek requests for proposals and the Request for Proposals itself seeking generation to meet an identified capacity deficit in 2023." ldaho Power Reply Comments p 2. ldaho Power noted that, as Staff discussed in its Comments, this difference is due to several factors including differences in timing, changed circumstances, and differing methodological approaches between the 2019 and 2021 IRPs. Also, as noted by Staff, the unusually long delay in the processing of the 2019 lRP, combined with the change in timing of the filing of the capacity determination for avoided costs from the time of filing of the !RP to the time of acknowledgment of the IRP caused an unusually large overlap in timing between the 2019 and 2021 IRP cycles, and a longer period of time over which circumstances changed. ldaho Power Reply Comments p 2-3. ldaho Power agreed with and accepted Staffs recommended changes and adjustments to the capacity deficiency date which are as follows: . Utilize the most recent load forecast developed by the Company; o Reduce the amount of Market Purchases from southern pathways by 310 MW and only include 50 MW starting in2021; . Allow non-PUPRA PPAs to expire on their actual expiration IDAHO POWER COMPANY'S MOTION AND AMENDED APPLICATION - 3 dates; a Reflect contract changes since the preparation of the L&R, which include PURPA contract updates identified in Response to Staffs Production Request No. 7 and approval of the Jackpot Solar contract; and . Correct the capacity value of Valmy Unit 2 and Bridger. Staff Comments, p 10. ldaho Power also expressed its preference that future capacity deficiency filings for PURPA avoided cost rates should revert back to the originally directed timing, to be made at the time the IRP is filed. ldaho Power Reply Comments p 4-5. III. AMENDED APPLICATION The Second Amended2Ol9 lRP, acknowledged by the Commission on March 16, 2021, indicates a first capacity deficit of 2028 which is reflected in the originalApplication for this mafter, filed on April 9, 2021. However, on December 3, 2021,ldaho Power filed an Application for Authority to Proceed with Resource Procurements, which discusses a rapid shift in ldaho Poweds capacity deficiency position starting in May 2021. Gase No. IPC-E-21*41, Application, p2-3,5-12. Additionally, on December30,2021,ldaho Power filed its 2021 lRP. Case No. IPC-E-2143. The 2021 lRP uses the most up-to-date resource and load inputs and indicates a first capacity deficit of approximately 101 MW starting in July 2023. 2019 lRP, p 17O. The first capacity deficit identified in the 2021 IRP of July 2023 is consistent with that discussed in Case No. !PC-E-2141, as well as the Requests for Proposals ('RFP") initiated by the Company seeking additional supply- side resources to meet the identified capacity deficits in 2023,2024, and 2025. ldaho Power proposes that, based upon the changed circumstances that have taken place with regard to the date of the first capacity deficit, the Commission allow the Company to Amend its Application to seek a first capacity deficit of July 2023, based upon ]DAHO POWER COMPANY'S MOTION ANDAMENDEDAPPLICATION -4 the 2021 IRP and consistent with the RFPs issued to meet deficits starting in 2023. The 2019 IRP was amended twice, and the Commission's consideration and eventual acknowledgement of the Second Amended 2019 IRP was considerably delayed. This, combined with the 2019 IRP being the first avoided cost first deficit update where the Commission changed the filing requirement from the time at which the IRP is filed to the time after which the IRP is acknowledged, resulted is substantia! delay in the consideration and setting of the first capacity deficit for avoided costs pricing. Attachment t hereto, incorporated herein by this reference, is the Load and Resource Balance Data from the 2021 !RP. Attachment 1 shows the previously referenced capacity deficits of 101 MW in July of 2023,186 MW in July of 2024, and 311 MW in July of 2025. 2019 lRP, p 170.3 ldaho Power requests that the first capacity deficit of July 2023 be utilized for avoided cost calculations for both the SAR and IRP methodologies. In addition, ldaho Power respectfully reiterates its previous position, and respectfully requests that the Commission direct that future capacity deficiency filings for PURPA avoided cost rates be made at the time the IRP is filed, as they have been in the past, rather than at the time the IRP is acknowledged. However, regardless of the Commission's position and determination as to the timing of future filings, ldaho Power believes good cause exists in this particular instance to grant ldaho Power's Motion for leave to amended its Application, and respectfully requests that the first capacity deficit of July 2023 be utilized for both SAR and IRP PURPA avoided cost methodologies. 3The Load and Resource Balance Data from lhe2021 IRP (Aftachment 1) also shows deficits occuning in July 202'l and July 2022. However, despite these earlier deficits in the Load and Resource Data the IRP does not add any new resources until 2023, so that is the basis of the first capacity deficit by which resources need to be acquired and should align with the basis for initiating capacity payments to PURPA QFs. MODIFIED PROCEDURE ldaho Power believes that a hearing is not necessary to consider the issues presented herein and respectfully requests that this Amended Application be processed under Modified Procedure, i.e., by written submissions rather than by hearing.
