Office of the Secretary
Service Date
May 14, 2021
BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION
On April 29, 2021, the city of Boise City (“Boise City”) filed a late petition to intervene
in the proceeding. No one opposed Boise City’s petition. Having reviewed the record, we
conditionally grant Boise City’s petition as follows.
FINDINGS
Commission Order No. 34986 set an April 27, 2021, deadline for petitions to intervene.
Boise City filed its petition to intervene on April 29, 2021. Boise City’s petition is, therefore,
untimely.
Untimely petitions to intervene are governed by Rules 71-75, IDAPA 31.01.01.071-
.075. Based on the record, we find that Boise City has shown good cause for the untimely filing,
and that it has a direct and substantial interest in this proceeding and will not unduly broaden the
issues. We thus find it reasonable to grant Boise City’s untimely petition to intervene on the
condition that Boise City not delay, disrupt, or unduly broaden the issues in this proceeding. We
note that, per Rule 73, Boise City is bound by all prior orders and notices issued in the case.
O R D E R
IT IS THEREFORE ORDERED that Boise City’s petition to intervene is granted on
the conditions specified above.
IT IS FURTHER ORDERED that all parties in this proceeding serve all papers
hereafter filed in this matter on all parties of record. For purposes of service, the Intervenor’s
