Enclosed please find a Summons and Complaint issued against Idaho Power Company in
Case No. IPC-E-20-17. As directed in the Summons, you are to file a written response in
defense of said Complaint with this Commission within 21 days of the service date of the
Summons.

In the Complaint, Black Mesa, LLC alleges it is entitled to twenty-year contracts and
published avoided cost pricing because its qualifying facilities, Black Mesa 1 and Black
Mesa 2, are “other” qualifying facilities under the Commission’s implementation of the
Public Utility Regulatory Policies Act of 1978. Black Mesa, LLC further alleges that the
Company has failed to comply with requirements of Schedule 73.
