SUBJECT: IN THE MATTER OF IDAHO POWER’S APPLICATION FOR
APPROVAL OR REJECTION OF THE FIRST AMENDMENT TO THE
ENERGY SALES AGREEMENT WITH EVERGREEN ENERGY, INC.;
CASE NO. IPC-E-21-05.
On March 23, 2021, Idaho Power (“Company”) filed an Application with the
Commission requesting approval of an amendment to its Energy Sales Agreement with Evergreen
Energy, Inc (“Evergreen”). Evergreen sells energy generated at the Tamarack CSSP project
(“Tamarack”) to the Company. Tamarack is a qualifying facility under the Public Utility
Regulatory Policies Act of 1978. The amendment would change the time by which Tamarack must
notify the Company of its estimated net energy production for the following month. Currently,
Tamarack must provide the Company its estimated net energy production one month in advance.
The amendment would change the reporting requirement to the 25th day of the month.
STAFF RECOMMENDATION
Staff recommends the Commission issue a Notice of Application and Notice of
Modified Procedure establishing a 21-day comment deadline and a 7-day reply comment deadline.
