HomeMy WebLinkAbout20200311Notice_of_Application_Order_No_34582.pdfOffice of the Secretary Service Date March 11,2020 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF IDAHO POWER'S )CASE NO.IPC-E-20-03 APPLICATION FOR APPROVAL OR )REJECTION OF AN ENERGY SALES )NOTICE OF APPLICATION AGREEMENT WITH LATERAL 10 )VENTURES,LLC FOR THE SALE AND )NOTICE OF PURCHASE OF ELECTRIC ENERGY FROM )MODIFIED PROCEDURE THE LATERAL #10 HYDRO PROJECT ) )ORDER NO.34582 On February 14,2020,Idaho Power Company applied for an order approving or rejecting its Energy Sales Agreement ("ESA")with Lateral 10 Ventures,LLC ("Lateral 10")for energy generated by the Lateral #10 Hydro project ("Facility").The Facility is a qualifyingfacility ("QF")under the Public Utility Regulatory Policies Act of 1978.The Facility's scheduled First Energy Date under the ESA is May 5,2020.Idaho Power asks the Commission to review its Application under Modified Procedure and issue a final order before May 4,2020. The Commission now issues this Notice of Application and Notice of Modified Procedure setting deadlines for public comments and Idaho Power's reply. NOTICE OF APPLICATION YOU ARE HEREBY NOTIFIED that the Facility is a 2.062 MW nameplate capacity hydro facility near Twin Falls,Idaho.Under the proposed ESA,Lateral 10 would sell Facility- generated electricity to Idaho Power. YOU ARE FURTHER NOTIFIED that Idaho Power states the ESA contains published non-seasonal,non-levelized hydro avoided cost rates for a 20-year term. YOU ARE FURTHER NOTIFIED that the ESA would replace an existing power sales agreement dated June 8,1984,which expires May 4,2020. YOU ARE FURTHER NOTIFIED that Idaho Power asks the Commission to declare all payments for purchases under the ESA be allowed as prudently incurred expenses for ratemaking purposes. YOU ARE FURTHER NOTIFIED that the Application is available for public inspection during regular business hours at the Commission's office.The Application is also available on the Commission's web site at www.puc.idaho.gov.Click on the "ELECTRIC"tab at NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO.34582 1 the top of the home page,then select "Open Cases"and then locate and click on the case number as shown on the front of this document. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission's jurisdiction under Title 61 of the Idaho Code.The Commission may enter any final order consistent with its authorityunder Title 61 and PURPA. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission's Rules of Procedure,IDAPA 31.01.01.000et seq. NOTICE OF MODIFIED PROCEDURE YOU ARE FURTHER NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter,and that it will proceed under Modified Procedure pursuant to Rules 201 through 204 of the Commission's Rules of Procedure,IDAPA 31.01.01.201through .204.The Commission notes that Modified Procedure and written comments have proven to be an effective means for obtaining public input and participation. YOU ARE FURTHER NOTIFIED that any person desiring to state a position on this Application must file a written comment in support or opposition with the Commission by March 31,2020.The comment must contain a statement of reasons supporting the comment.
