HomeMy WebLinkAbout20200519Notice_of_Modified_Procedure_Order_No_34672.pdfNOTICE OF MODIFIED PROCEDURE ORDER NO. 34672 1 Office of the Secretary Service Date May 19, 2020 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION On May 31, 2019, the Commission ordered Idaho Power Company (“Idaho Power” or “Company”) to “use best efforts to file, within 21 days of the service date of this Order; (1) an analysis validating the December 31, 2025 economic retirement date of Unit 2 [of the North Valmy plant]: or (2) an analysis supporting a different economic retirement date of Unit 2 [of the North Valmy power plant].” Order No. 34349. On June 27, 2019, Idaho Power submitted an Application requesting the Commission acknowledge the Company sufficiently validated December 31, 2025 as the economic retirement date for Unit 2 of the North Valmy power plant. On August 13, 2019, the Commission issued a Notice of Application but did not determine a procedure or set a timeline to process this case because the Company had notified the Commission it would need more time to analyze factors bearing on the long-term capacity expansion model used in the Company’s Integrated Resource Plan (“IRP”). Order No. 34398. On January 31, 2020, Idaho Power submitted its amended 2019 IRP. On March 6, 2020, the Commission issued a Notice of Intervention Deadline. Order No. 34575. Industrial Customers of Idaho Power and Idaho Conservation League intervened. Commission Staff then conferred with the parties about a schedule. Staff informed the Commission that the Company would provide supplemental testimony by May 22, 2020 to update the analysis performed since the Application was submitted. The Commission now issues this Notice of Modified Procedure establishing comment deadlines. NOTICE OF MODIFIED PROCEDURE YOU ARE HEREBY NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter, and that it will proceed under Modified Procedure pursuant to Rules 201 through 204 of the Commission's Rules of Procedure, IDAPA IN THE MATTER OF IDAHO POWER’S APPLICATION FOR A VALIDATED ECONOMIC CLOSURE DATE FOR NORTH VALMY POWER PLANT UNIT 2 ) ) ) ) ) ) CASE NO. The Commission notes that Modified Procedure and written comments have proven to be an effective means for obtaining public input and participation. YOU ARE FURTHER NOTIFIED that anyone desiring to state a position on this Application must file a written comment in support or opposition with the Commission by August 19, 2020. The written comment must contain a statement of reasons supporting it. Persons desiring a hearing must specifically request a hearing in their written comments. NOTICE OF MODIFIED PROCEDURE ORDER NO. 34672 3 O R D E R IT IS HEREBY ORDERED that the Application of the Company be processed by Modified Procedure, Rule 201-204 (IDAPA 31.01.01.201-.204). Persons interested in submitting written comments must do so by August 19, 2020. The Company must file any reply comments by September 2, 2020 IT IS FURTHER ORDERED that parties should continue to comply with Order No. 34602, issued March 17, 2020. All pleadings should be filed with the Commission electronically and shall be deemed timely filed when received by the Commission Secretary. See Rule 14.02. Service between parties should also be accomplished electronically. Voluminous discovery-related documents may be filed and served on CD-ROM or a USB flash drive.
