HomeMy WebLinkAbout20200306Notice_of_Intervention_Deadline_Order_No_34575.pdfOffice of the Secretary Service Date March 6,2020 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF THE APPLICATION )CASE NO.IPC-E-19-18 OF IDAHO POWER FOR A VALIDATED )ECONOMIC CLOSURE DATE FOR NORTH )NOTICE OF VALMY POWER PLANT UNIT 2 )INTERVENTION DEADLINE )ORDER NO.34575 On May 31,2017,the Commission approved a settlement stipulation that required Idaho Power Company ("Idaho Power"or "Company")to use prudent and commercially reasonable efforts to end its participation in Unit 1 of the North Valmy power plant ("Valmy")by December 31,2019,and Unit 2 by December 31,2025.Order No.33771. On May 31,2019,the Commission approved ratemaking treatment for the December 31,2019,retirement of Unit 1 and ordered the Company to use best efforts to file,within 21 days of the Commission's order,additional analysis validating the December 31,2025,economic retirement date for Unit 2.Order No.34349. On June 27,2019,Idaho Power filed an Application requesting the Commission acknowledgethe Company sufficientlyvalidated December 31,2025,as the economic retirement date of Unit 2 of Valmy. On July 19,2019,the Company filed a letter in Case No.IPC-E-19-19 stating that it needed additional time to perform modeling and analysis for its 2019 Integrated Resource Plan ("IRP"). On August 6,2019,Commission Staff recommended the Commission issue a Notice of Application,but not determine procedure or set deadlines until after the Company submitted its amended 2019 IRP because the amended IRP might affect the economic analysis conducted in this case. On August 13,2019,the Commission issued a Notice of Application.Order No.34398. On January 31,2020,the Company submitted its amended 2019 IRP in Case No.IPC- E-19-19. The Commission now issues this Notice of Intervention Deadline. NOTICE OF INTERVENTION DEADLINE ORDER NO.34575 1 NOTICE OF INTERVENTION DEADLINE YOU ARE HEREBY NOTIFIED that a Notice of Application was previously issued in this case.Order No.34398. YOU ARE FURTHER NOTIFIED that in Case No.IPC-E-16-24 and IPC-E-19-08, Commission Staff requested additional economic analysis from the Company demonstrating the economic retirement date of Unit 2.Order Nos.33771 at 4,34349 at 2. YOU ARE FURTHER NOTIFIED that the modeling issues identified in the 2019 IRP required the Company to conduct supplemental analysis to validate the December 31,2025, economic retirement date.See Application at 3 (describing the reliance on the 2019 IRP to perform economic retirement analysis for Unit 2). YOU ARE FURTHER NOTIFIED that persons who wish to intervene in this matter to obtain the rights of party (e.g.,to file formal discovery,or present evidence or cross-examine witnesses at a hearing)must file a Petition to Intervene with the Commission under the Commission's Rules of Procedure 72 and 73,IDAPA 31.01.01.072and .073.Persons who wish to intervene as a party must file a Petition to Intervene no later than twenty-one days following the service date of this Notice.Such persons shall also provide the Commission Secretary with their electronic mail address to facilitate further communications. YOU ARE FURTHER NOTIFIED that persons who would like to present their views without parties'rights of participation and cross-examinationare not requiredto intervenebut may present their views by submitting written comments to the Commission. YOU ARE FURTHER NOTIFIED that the Commission Secretary shall issue a Notice of Parties after the deadline for intervention has passed.The Notice of Parties shall assign exhibit numbers to each party in this proceeding. YOU ARE FURTHER NOTIFIED that once the Notice of Parties is issued, Commission Staff will informally confer with the parties to discuss a schedule to process this case and other issues as raised by the parties. IT IS FURTHER ORDERED that,after the Secretary issues a Notice of Parties,Staff will informally confer with the parties to discuss the appropriate scheduling of this case.
