At the Commission's regularly scheduled Decision Meeting on February 19,2019, Commission Staff recommended that the proposed effective date of the Tariff Advice be suspended and the filing processed as an Application by Modified Procedure.Staff's recommendation was based on its belief that the proposed change is not minor,as required by Rule 134.01 of the Commission's Rules of Procedure. The Commission now issues this Notice of Suspension of the proposed effective date, Notice of Application,and Notice of Modified Procedure,and sets a comment deadlineand a reply comment deadline. NOTICE OF SUSPENSION Idaho Power filed Tariff Advice No.19-02 on February 1,2019 and requested a March 4,2019 effective date.To allow adequate opportunity for public input,and pursuant to Idaho Code §§61-622 and 61-623,the Commission suspends the proposed effective date for thirty (30)days plus five (5)months from March 4,2019,or until the Commission enters an Order accepting, rejecting,or modifying the request in this matter. NOTICE OF SUSPENSION NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO.34251 1 NOTICE OF APPLICATION Under Rule 134.02 of the Commission's Rules of Procedure,"If a tariff advice is suspended,the Commission will open a formal proceeding and treat the tariff advice as an application."A formal proceedingunder the Commission's Rules of Procedure involves a record to be preserved for Commission or judicialreview.See Rules 21 through 30 of the Commission's Rules of Procedure. The Company filed its 2019 CommunitySolar Annual Report ("2019 Annual Report") concurrentlywith Tariff Advice 19-02.The Company submitted the 2019 Annual Report ahead of the April 30,2019,due date for the report to inform the Commission's decision on whether to suspend the Program. YOU ARE HEREBY NOTIFIED that Tariff Advice No.19-02 will be processed as an Application under Case No.IPC-E-19-05. YOU ARE FURTHER NOTIFIED that the Community Solar Pilot Program was approved by the Commission in Order No.33638.Under the Program,the Company proposed to build a 500 kilowatt solar array in southeast Boise.2019 Community Solar Annual Report at 1. The Company estimated the cost of construction at the time would be $1.2 million.Id.At the peak of Program enrollment,239 subscriptions were purchased,equal to 15.3%of the total Program.Id.at 6.When the Company filed the Application,there were 148 subscriptions issued, equal to roughly9.5%of the Program.Id The Company bases its request to suspend the Program on insufficient enrollment.Application at 1. YOU ARE FURTHER NOTIFIED that the Company's 2019 CommunitySolar Annual Report contains information on the Company's outreach and marketing efforts for the Program, Program enrollment,subscriber characteristics,customer feedback,a customer communication plan if suspension is approved,and other information on the Program.The 2019 Community Solar Annual Report is available in case file IPC-E-19-05. YOU ARE FURTHER NOTIFIED that the Application and the 2019 Community Solar Annual Report is available for public inspection during regular business hours at the Commission office.These documents are also available on the Commission's web site at www.puc.idaho.gov. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission's Rules of Procedure,IDAPA 31.01.01.000 et seq. NOTICE OF MODIFIED PROCEDURE YOU ARE FURTHER NOTIFIED that the Commission has determinedthat the public interest may not require a formal hearing in this matter,and that it will proceed under Modified Procedure pursuant to Rules 201 through 204 of the Commission's Rules of Procedure,IDAPA 31.01.01.201 through .204.The Commission notes that Modified Procedure and written comments have proven to be an effective means for obtaining public input and participation. YOU ARE FURTHER NOTIFIED that any person desiring to state a position on this Application may file a written comment in support or opposition with the Commission by no later than March 28,2019.The comment must contain a statement of reasons supporting the comment.Persons desiring a hearing must specifically request a hearing in their written comments. ORDER IT IS HEREBY ORDERED that the proposed effective date for Tariff Advice 19-02 is suspended for thirty (30)days plus five (5)months from March 4,2019,or until the Commission enters an Order accepting,rejecting,or modifying the request.See Idaho Code §61-622(4). IT IS FURTHER ORDERED that Tariff Advice 19-02 be converted into an Application,under Commission Rule of Procedure 134.02,and given the Case No.IPC-E-19-05. IT IS FURTHER ORDERED that the Company's Application be processed by Modified Procedure,Rule 201-204 (IDAPA 31.01.01.201-.204).Persons interested in submitting written comments must do so by March 28,2019.The Company may file reply comments by no later than April 4,2019.
