HomeMy WebLinkAbout19910305.docx Minutes of Decision Meeting March 5, 1991 - 9:15 a.m. In attendance: Commissioners Joe Miller, Ralph Nelson and Marsha Smith.  Also in attendance were:  Don Howell, Tonya Clark and Myrna Walters. Commissioner Miller asked who was in favor of vacating the St. Anthony railroad hearing. Commissioners Nelson and Smith indicated they were as was Commissioner Miller. Don Howell suggested a letter or copy of an order be sent to the ICC. Commissioner Smith said she thought it would be fun to say once again Union Pacific has failed to provide service, cannibalized the line and asked for exemption. Commissioner Nelson said he wondered about sending a letter to Jake Simmons.  Could send letter to the Secretary with cc to Simmons.  Think we should be talking to Transportation about the guys paving over the tracks. Commissioner Smith said they do ask the railroad first. Don Howell said Commission does have to issue an order.  Think they should remove the cross buck.  There is no reason to have those if the line is closed.  Send these comments to Bridger, the new superintendent over there. Commissioner Miller said his inclination would be to issue an order saying there will be no hearing because there is apparently no reason. Commissioner Nelson said he didn't think sending anything to anyone will do any good. Commissioner Miller said we could express our continuing concern about what appears to be a pattern of conduct. Commissioner Nelson said this guy has requested cars so exemption is probably not proper. Don Howell said he thought Commission should say there is evidence to indicate that cars have been ordered in the past 2 years and company failed to provide service and think exemption route is improper route, but it appears it is the route they are going. -2- Don Howell said order should speak to embargoing the bridge.
