HomeMy WebLinkAbout20180726notice_of_application_order_no_34113.pdfOffice of the Secretary Service Date July 26,2018 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF IDAHO POWER )CASE NO.IPC-E-18-10 COMPANY'S APPLICATION FOR AN ) ORDER APPROVING THE TRANSFER )NOTICE OF APPLICATION AND SALE OF CERTAIN ASSETS TO )JAYCO,INC.)NOTICE OF )MODIFIED PROCEDURE )ORDER NO.34113 On June 6,2018,Idaho Power Company,("Company"),filed an Application requesting authorityto sell and transfer certain assets to Jayco,Inc.("Jayco"),under its Asset Purchase and Transfer of Title Agreement,Idaho Code §§61-328 and 61-524,and Rule of Procedure 052. Application at 1.Pursuant to Idaho Code §61-328,Idaho Power requests that the Commission approve the sale and transfer of property and to process the Application by Modified Procedure. Id.at 4. NOTICE OF APPLICATION YOU ARE HEREBY NOTIFIED that Idaho Power's Application states that it provides electric service at Jayco's manufacturing facility in Idaho Power's service territory.Id.at 2.Idaho Power states that it owns and operates transformers and other facilities beyond the point of delivery ("POD")for the sole purpose of meeting Jayco's specific service requirements.Id.Jayco pays Idaho Power a monthlyfacilities charge to provide this optional service.Id. YOU ARE FURTHER NOTIFIED that Jayco has requested that Idaho Power sell the Assets described in Exhibit A to the Application to it under the Asset Purchase and Transfer of Title Agreement (Attachment 1 to the Application),and according to Idaho Power's Rule M.Id. Upon approval of the transfer and the closing of the sale Jayco would own all facilities installed beyond Idaho Power's current POD.Id. YOU ARE FURTHER NOTIFIED that the Company's Application includes a sale price methodology and accounting treatment when determining sale prices for customers electing to purchase Company-owned facilities under Rule M.Exhibit B to the Application provides a breakdown of the total purchase price of $44,582.Id.at 5-11;and Exhibit B. NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO.34113 1 YOU ARE FURTHER NOTIFIED that the Application and Attachment 1 (the Asset Purchase and Transfer of Title Agreement),as well as Exhibits A-C thereto,have been filed with the Commission and are available for public inspection during regular business hours at the Commission offices.The Application and attachments are also available on the Commission's web site at Click on the "File Room"tab at the top of the page,scroll down to the type of "Open Electric Cases,"and then click on the case number as shown on the front of this document. NOTICE OF MODIFIED PROCEDURE YOU ARE FURTHER NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter and will proceed under Modified Procedure pursuant to Rules 201 through 204 of the Idaho Public Utilities Commission's Rules of Procedure, IDAPA 31.01.01.20l-204.The Commission notes that Modified Procedure and written comments have proven to be an effective means for obtaining public input and participation. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission's jurisdictionunder Title 61 of the Idaho Code,and specifically Idaho Code §61-503.The Commission may enter any final Order consistent with its authority under Title 61. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission's Rules of Procedure,IDAPA 31.01.01.000,et seq. ORDER IT IS HEREBY ORDERED that this case be processed under Modified Procedure, Rule 201-204 (IDAPA 31.01.01.201 -.204).Parties and persons shall have until August 14,2018, to file written comments,and the Company shall have until August 21,2018 to file a reply,if any.
