SIMPLOT COMPANY, AND THE RENEWABLE ENERGY COALITION FOR MODIFICATION OF THE 9O/IIO PERFORMANCE BAND AND CALCULATION OF OPERATION AND MAINTENANCE CHARGES FOR PURPA QUALIFYING FACILITIES; CASE NO. IPC-E-18-07. The Commission has before it J.R. Simplot Co.'s Unopposed Motion to Extend Stay in this matter. BACKGROIJND On April 16, 2018, Idahydro, Shorock Hydro,lnc., the J.R. Simplot Company, and the Renewable Energy Coalition jointly petitioned the Commission to modiff, amend, or stay existing orders or rules, and to clarify rights and obligations implementing Section 210 of the Public Utilities Regulatory Policy Act of 1978, 16 U.S.C. $824a-3 et seq. On May 30, 2018, the Commission set an intervention deadline and directed the pa(ies to confer about a case schedule. Tamarack Energy Partnership and Avista Corp. intervened. The parties met and conferred, as directed. Before a scheduling agreement could be reached, ldaho Power announced it would file a cross-petition. The parties agreed to suspend discussions until they had a chance to review the cross-petition. Idaho Power filed its cross-petition on July 25,2018. On August 8, 2018, J.R. Simplot Co. filed an Unopposed Motion to Stay Proceedings. On August I 5, 2018, the Commission granted the motion and stayed further proceedings and deadlines until September 12, 2018. DECISION MEMORANDUM 1 MOTION TO EXTEND STAY On September ll, 2018, J.R. Simplot Co. filed an Unopposed Motion to Extend Stay of Proceedings, requesting the Commission stay all pending deadlines and proceedings for an additional 2l days or until the Commission grants any party's motion to lift the stay. Fu*hennore, Petitioners represent that they are in agreement with ldaho Power to extend all pending deadlines in this matter for an additional seven days after the stay is lifted. Staff recommends the Commission grant the motion. COMMISSION DECISION Does the Commission wish to (l) grant the Petitioner's Motion to Extend Stay of Proceedings and stay all proceedings and deadlines for 2l days from the date of the Commission's Order or until the Commission grants any party's motion to lift the stay?
