HomeMy WebLinkAbout20170414order_no_33743.pdfOffice of the Secretary Service Date April 14,2017 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF THE PETITION OF ) IDAHO POWER COMPANY FOR A )CASE NO.IPC-E47..O1 DECLARATORY ORDER REGARDING ) PROPER CONTRACT TERMS,) CONDITIONS,AND AVOIDED COST )ORDER NO.33743 PRICING FOR BATTERY STORAGE ) FACILITIES ) On April 4,2017,Idaho Conservation League and Sierra Club moved the Idaho Public Utilities Commission (Commission),under Commission Rules of Procedure 19 and 43.03 and Idaho Bar Commission Rule (IBCR)227,for an Order approving the limited admission,pro hac vice,of David Bender in this matter.The Motion was signed and attested to by local counsel Benjamin Otto of Boise,Idaho (Idaho State Bar License No.8292). In the Motion,Mr.Bender certifies that he is an active member in good standing of the Wisconsin State Bar who maintains the regular practice of law in Wisconsin.He further declares that he is not an Idaho resident or licensed to practice law in Idaho. Mr.Bender and Mr.Otto certify that a copy of the Motion has been served on all other parties to this case,and that a copy of the Motion,accompanied by a $325 fee and certificate of good standing,have been submitted to the Idaho State Bar.Mr.Otto acknowledges that his attendance shall be required at all Commission proceedings in which Mr.Bender appears,unless specifically excused by the Commission. COMMISSION FINDINGS The Commission has reviewed and considered the Motion and applicable rules, including IBCR 227 and Commission Rules of Procedure 19 and 43.03,IDAPA 3 1.01.01.019 and 043.03.Based on the filings of record and certified representations of Mr.Bender and Mr. Otto,we find that reasonable grounds have been demonstrated to justify the granting of limited admission of Mr.Bender as legal counsel for Idaho Conservation League and Sierra Club.We further find good reason to excuse the appearance of Mr.Otto in further proceedings in this docket unless needed by Mr.Bender. CONCLUSIONS OF LAW The Commission has jurisdiction in this case and over this Motion pursuant to Idaho Code,Title 61,and the Commission’s Rules of Procedure,3 1.01.01.000 et seq. ORDER NO.33743 ORDER IT IS HEREBY ORDERED that the Motion is granted;David Bender is hereby granted limited admission as legal counsel for Idaho Conservation League and Sierra Club in Case No.IPC-E-1 7-01.IDAPA 31.01.01.043.03 .a. IT IS FURTHER ORDERED that the attendance of Benjamin Otto is excused from all further proceedings in Case No,IPC-E-17-01 unless needed by David Bender.
