HomeMy WebLinkAbout20170209intervention_order_no_33716.pdfOffice of the Secretary Service Date February 9,2017 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF THE APPLICATION ) OF IDAHO POWER COMPANY FOR A )CASE NO.IPC-E4632 DETERMINATION OF HELLS CANYON ) COMPLEX RELICENSING COSTS ) THROUGH 2015 AS PRUDENTLY )ORDER NO.33716 INCURRED ) Idaho Conservation League (ICL)petitioned to intervene in this case on January 30, 2017,after the January 25,2017,deadline for intervention had passed.See Rules of Procedure 71 through 75 of the Idaho Public Utilities Commission,IDAPA 31.01.01.071-.075.On January 31,2017,ICL filed an Amended Petition to Intervene stating that ICL’s counsel miscounted the 21-day intervention period.ICL claims a direct and substantial interest in this proceeding,and that it and its supporters may be impacted by the outcome.Amended Petition at 2. FINDINGS OF FACT We find that no party timely opposed this Petition to Intervene. We further find that based on the pleadings and other documents filed in this case, intervention by this party would serve the purposes of intervention as described by Rule 74 of the Rules of Procedure.We also find that granting this late intervention will not prejudice any party and that late intervention should be granted. ORDER IT IS THEREFORE ORDERED that the Petition to Intervene filed by the Idaho Conservation League is hereby granted.
