On December 19, 2016, Micron Technology, Inc. moved the Idaho Public Utilities
Commission (Commission), under Commission Rules of Procedure 19 and 43.03 and Idaho Bar
Commission Rule (IBCR) 227, for an Order approving the limited admission, pro hac vice, of
Emanuel T. Cocian, Thorvald A. Nelson, and Frederick J. Schmidt in this matter. The Motions
were signed and attested to by local counsel Brian T. Hansen of Boise, Idaho (Idaho State Bar
License No. 6087).
In the Motion for Mr. Cocian's limited admission, Mr. Cocian certifies that he is an
active member in good standing with the bar of the states of Colorado, Georgia and Wyoming
who maintains the regular practice of law in Colorado. He further declares that he is not an
Idaho resident nor licensed to practice law in Idaho.
In the Motion for Mr. Nelson's limited admission, Mr. Nelson certifies that he is an
active member in good standing with the bars of the states of Colorado and Montana who
maintains the regular practice of law in Colorado. He further declares that he is not an Idaho
resident nor licensed to practice law in Idaho. Also, he certifies that he has been admitted pro
hac vice in 2016 for Case Number BWL-T-16-01, before this Commission.
In the Motion for Mr. Schmidt's limited admission, Mr. Schmidt certifies that he is an
active member in good standing with the bar of the state of Nevada who maintains the regular
practice of law in Nevada. He further declares that he is not an Idaho resident or licensed to
practice law in Idaho.
Mr. Cocian, Mr. Nelson, Mr. Schmidt and Mr. Hansen certify that a copy of the
Motions have been served on all other parties to this case, and that a copy of the Motions,

accompanied by a $325 fee and certificate of good standing, have been submitted to the Idaho
State Bar. Mr. Hansen acknowledges that his attendance shall be required at all Commission
proceedings in which Mr. Cocian and Mr. Schmidt appear, unless specifically excused by the
Commission.
COMMISSION FINDINGS
The Commission has reviewed and considered the Motions and applicable rules,
including IBCR 227 and Commission Rules of Procedure 19 and 43.03, IDAPA 31.01.01.019
and 043.03. "Out-of-state attorneys representing the same party in one (I) or more quasi-judicial
proceedings must request limited admission at least one (1) time per calendar year." IDAPA
3 l.01.01.043.03(a). Based on the filings of record and certified representations of Mr. Cocian,
Mr. Nelson, Mr. Schmidt and Mr. Hansen, we find it unnecessary for Mr. Nelson to request
limited admission in this case as he has already been granted pro hac vice admission in 2016.
We further find that reasonable grounds have been demonstrated to justify the granting of limited
admission of Mr. Cocian and Mr. Schmidt as legal counsel for Micron Technology, Inc. In
addition, we find good reason to excuse the appearance of Mr. Hansen in further proceedings in
this docket unless needed by Mr. Cocian, Mr. Nelson, and Mr. Schmidt.
CONCLUSIONS OF LAW
The Commission has jurisdiction in this case and over these Motions pursuant to
Idaho Code, Title 61, and the Commission's Rules of Procedure, 31.01.01.000 et seq.
ORDER
IT IS HEREBY ORDERED that the Motion is granted; Emanuel T. Cocian is hereby
granted limited admission as legal counsel for Micron Technology, Inc.
IT IS FURTHER ORDERED that the Motion is granted; Frederick J. Schmidt is
hereby granted limited admission as legal counsel for Micron Technology, Inc.
IT IS FURTHER ORDERED that the attendance of Brian T. Hansen is excused from
all further proceedings in Case Nos. IPC-E-16-23 and IPC-E-16-24 unless needed by Mr. Cocian
Mr. Nelson, and Mr. Schmidt.
