Industrial Customers of Idaho Power (ICIP)petitioned to intervene in this case on
April 14,2016,pursuant to Rules of Procedure 71 through 75 of the Idaho Public Utilities
Commission,DAPA 31.01.0l.071-.075.ICW also served a First Production Request on Idaho
Power.Idaho Power timely opposed ICIP’s intervention.We considered the matter at the
decision meeting on April 25,2016,and now grant ICIP intervention.
FINDINGS OF FACT
The Legislature has declared it “the policy of this state to encourage participation at
all stages of all proceedings before the commission.”Idaho Code §61-617A.In keeping with
this stated intent,the Commission has liberally allowed intervention where the purposes of
intervention,as described in Rule 74 of the Rules of Procedure,are served.
We find,based on the pleadings and other documents filed in this case,and given our
long history of liberally allowing intervention,that Rule 74 is satisfied.We therefore grant ICW
intervention.We do not address ICIP’s discovery request,which was served on Idaho Power
before ICIP was granted status as an intervening party.If a discovery dispute arises,the
Commission will consider such issue in a motion brought before it.
ORDER
IT IS HEREBY ORDERED that the Petition to Intervene filed by the Industrial
Customers of Idaho Power is hereby granted.
IT IS FURTHER ORDERED that all parties in this proceeding serve all papers
hereafter filed in this matter on all parties of record.This Intervenor is represented by the
