ldaho Power Company ("ldaho Powe/' or "Gompany"), in accordance with RP 53,
ldaho Powe/s Schedule 73, and the applicable provisions of the Public Utility
Regulatory Policies Act of 1978 ('PURPA"), hereby respectfully petitions the ldaho
Public Utilities Commission ("Commission") for an order determining that the ten 100
kilowatt ("kW') PURPA solar projects, proposed by Site Based Energy as WRCE 1
through WRCE 10, be subject to the Commission's interim relief approving maximum
contract terms of five years as directed in Order Nos. 33222 and 33253 and further, that
such projects also be subject to the Commission's ultimate determination regarding

maximum contract term in Case No. IPC-E-15-01, which is currently scheduled for
technical hearing on June 29,30, and July 1,2015.
In support of this Petition, ldaho Power represents as follows:
I. INTRODUGTION
On January 30, 2015,ldaho Power filed a petition with the Commission seeking
a reduction of the required contract term for PURPA Qualifying Facility ('QF') contracts
to a maximum of two years for new QF contracts that exceed the published rate
eligibility cap. Case No. IPC-E-15-01, ldaho Powe/s Petition at 1-2. On February 6,
2015, the Commission granted interim relief by reducing the maximum contract term to
five years. Order No. 33222. The Commission then clarified that the five year
maximum contract term applied to projects over the published rate eligibility cap, which
is 100 kW for solar QF projects. Order No. 33253.
II. FACTS
On June 15,2015, ldaho Power received hard copy and electronic submissions
for ten 100 kW PURPA solar QF projects, all from the same developer, John Reuter,
from Site Based Energy. See Attachment Nos. 1 through 10, attached hereto and
incorporated herein by this reference, which contain the Energy Sales Agreement
Applications and materials ("Application" or "Applications") ldaho Power received from
WRCE 1 through 10, respectively. These ten projects are all located at the same site,
on the same contiguous property, and divided into ten sections, as show on the map
attached to each Application. ld. Each Applicatlon appears to be nearly identical,
except for the differing Name of Facility, WRCE 1 through 10, respectively, and the
coresponding GPS coordinates for each project. ld. Each Application requests a
contract term of 20 years. ld., al2.

Idaho Power acknowledged receipt of said Applications on June 16,2015, and
informed Site Based Energy that the Company would review the Applications with
respect to the requirements of Schedule 73. See Attachment No. 11, attached hereto
and incorporated herein by this reference, which contains a copy of the e-mail
communication from Site Based Energy and ldaho Powe/s response e-mail.
Contemporaneous with the filing of this Petition, ldaho Power sent its response letter to
Site Based Energy, as required within ten business days of receipt of the Schedule 73
application, informing Site Based Energy of this filing. See Attachment No. 12, attached
hereto and incorporated herein by this reference.
III. DISCUSSION
The Commission should direct that the five year maximum contract term
limitation cunently in place for projects over the published rate eligibility cap be
applicable to these ten 100 kW disaggregated solar projects. The Commission
instituted the 100 kW published rate eligibility cap for wind and solar QFs in 2011 in
response to the practice of numerous PURPA wind QF projects disaggregating larger
projects into 10 average megawatt increments in order to gain access to published
avoided cost rates, as opposed to the negotiated avoided cost rate methodology
applicable to proposed QF projects over the eligibility cap. Order Nos. 32176 and
32262.
Here, Site Based Energy has specifically designed and proposed its project-
disaggregated into 100 kW increments-in an attempt to avoid application of the
Commission's interim order limiting the maximum contract term to five years. This is
exactly the same kind of manipulation of the Commission's rules-designed to
circumvent the application of the Commission's orders and implementation of PURPA-

that the Commission determined to prevent in Case Nos. GNR-E-10-04 and
GNR-E-11-01, as well as the previously cited Order Nos. 32176 and32262. There is no
other explanation for the strained and manipulated configuration of the proposed ten
100 kW projects other than to obtain published rate, 20-year contracts. The projects are
all located at the same site and are depicted as being on one contiguous, rectangular
piece of land--divided into ten pieces. See map of proposed project attached to each
Application, Exhibit Nos. 1 through 10. Each Application requests a contract term of 20
years, requests published avoided cost rates, and states, "The facility will be owned by
a separate owner than all other facilities within 1 mile, including other facilities at the
same site." Exhibit Nos. 1 through 10, Applications at 2. However, ldaho Power has
not been provided with any evidence of separate ownership, nor was ldaho Power able
to confirm that the proposed entities are registered with the ldaho Secretary of State.
This is a direct attempt at manipulating the Commission's cunent rulings and orders by
a proposed QF project to the detriment of ldaho Power customers and should not be
permitted by the Commission.
IV. CONCLUSION AND REQUEST FOR RELIEF
A proposed solar QF project over 100 kW is only eligible for a contract with a
maximum contract term of five years. Site Based Energy's proposed ten 100 kW
projects are specifically disaggregated into 100 kW increments using a common design
scheme and nomenclature in an attempt to manipulate the Commission's rulings to
inappropriately gain access to 2O-year contracts. The practice of disaggregating
projects in order to manipulate the Commission's rules has been rejected and
disapproved by the Commission in the past. ldaho Power asks that the Commission
direct its interim relief, maximum contract term of five years, as well as any

determination as to the maximum contract term resulting from Case No. IPC-E-15-01,
be applicable to the ten 100 kW projects identified as WRCE 1 through 10 proposed by
Site Based Energy.

Dear John,
Idaho Power Company ('Idaho Powet'') is in receipt of an email from Site Based Energy dated June 15, 2015,
which contains updated ldaho Schedule 73 Applications and requests for indicative pricing proposals for ten,
100 kilowatt (*kW") proposd solarprojects ("Projects"). Schedule 73 states that Idaho Power will notifr the
applicant of any deficiencies or an indicative pricing proposal within l0 business days. 10 business days
following yourJune 15, 2015, submission is June 29,2015.
On June 26,zDls,Idaho Power frled a petition with the ldaho Public Utilities Commission ('Commission')
requesting the Commission's determination as to tle appropriate contract temr for your ten, 100 kW PURPA
solar projects, proposed as WRCE I through WRCE 10. In that Petition, Idaho Power requests that your
Projects be subject to the Commission's interim relief approving maximum contract terms of five years as
directed in Order Nos. 33222 and33253, and further that such Projects also be subject to the Commission's
ultimate determination in Case No. IPC-E-I5-01, which is currently scheduled for technical hearing on June 29,
30, and July l, 2015.
Please let this letter, and its reference to the petition, serv€ as Idaho Power's response pursuant to Schedule 73,
until such time as the Commission makes its determination upon Idaho Power's petition.
