HomeMy WebLinkAbout20130104notice_of_filing_order_no_32708.pdfOffice of the Secretary Service Date January 4.2013 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF TARIFF ADVICE NO.)CASE NO.IPC-E-12-28 12-13 OF IDAHO POWER COMPANY FOR ) AUTHORITY TO UPDATE SCHEDULE 89.)NOTICE OF FILING ) )NOTICE OF )MODIFIED PROCEDURE ) __________________________________ )ORDER NO.32708 On November 28.2012,Idaho Power Company filed Tariff Advice No.12-13 with the Commission seeking authority to update Schedule 89 with a backdated effective date of January 1,2012.Staff recommended that the tariff advice be suspended and that the case be processed by Modified Procedure.See IPUC Rule of Procedure 134.02 (a “tariff advice not suspended or approved goes into effect thirty (30)days after filing or on the proposed effective date,whichever is later”).At the Commission’s regularly scheduled December 17,2012, Decision Meeting the Commission suspended the tariff advice and determined that the case should be processed by Modified Procedure. NOTICE OF TARIFF ADVICE NO.12-13 YOU ARE HEREBY NOTIFIED that,based on previous Commission Order,the pricing under Schedule 89 is to be adjusted as a result of an Idaho Power general rate case proceeding where net power supply expenses change.Due to extenuating circumstances, Schedule 89 was not updated as part of the Company’s original general rate case compliance filing on December 30,2011. YOU ARE FURTHER NOTIFIED that,upon the Company’s review of Schedule 89 and what triggers its update,the Company has concluded that,while the separate events of(l)an update to NPSE and (2)the occurrence of a general rate case proceeding did not occur simultaneously as they had historically,the combined effect of the consecutive occurrences of these individual events had the same effect. YOU ARE FURTHER NOTIFIED that the Company proposes to update Schedule 89 as if it were part of the Company’s original compliance filing on December 30,2011,with an effective date of January 1,2012. NOTICE OF FILING NOTICE OF MODIFIED PROCEDURE ORDER NO.32708 1 NOTICE OF MODIFIED PROCEDURE YOU ARE FURTHER NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter and will proceed under Modified Procedure pursuant to Rules 201 through 204 of the Idaho Public Utilities Commission’s Rules of Procedure,IDAPA 3 1.01.01.201-204.The Commission notes that Modified Procedure and written comments have proven to be an effective means for obtaining public input and participation. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission’s Rules of Procedure,IDAPA 31 .01.01.000,ci seq. SUSPENSION OF PROPOSED EFFECTIVE DATE Pursuant to Rule 134.02 of the Commission’s Rules of Procedure,a “tariff advice not suspended or approved goes into effect thirty (30)days after filing or on the proposed effective date,whichever is later.”Idaho Power filed Tariff Advice i’o.12-13 on November 28,2012, with a backdated effective date of January 1,2012.In the interest of persons and parties that may be impacted by the proposed update to Schedule 89,and pursuant to Idaho Code §§61-622 and 61-623,the Commission hereby suspends the proposed update for a period of thirty (30) days plus five (5)months from November 28,2012,or until such time as the Commission enters an Order accepting,rejecting or modifying the request in this matter. ORDER IT IS HEREBY ORDERED that Tariff Advice 12-13 filed by Idaho Power for authority to update its Schedule 89 is suspended for a period of thirty (30)days plus five (5) months from November 28,2012,or until such time as the Commission enters an Order accepting,rejecting or modifying the request in this matter. IT IS FURTHER ORDERED that the case be processed by Modified Procedure. Persons interested in submitting written comments in this matter must do so no later than January 25,2013. IT IS FURTHER ORDERED that Idaho Power may file reply comments no later than February 1,2013.
