SUBJECT: COMPLAINT OF FALL RIVER RURAL ELECTRIC COOPERATIVE V.
IDAHO POWER, CASE NO. IPC-E-I0-31
On November 8, 2010, Fall River fied a formal complaint against Idaho Power
Company regarding entitlement to a power purchase agreement containing published avoided
cost rates. On December 2, 2010, Fall River informally requested that the Commission not issue
a summons to Idaho Power as the parties have tentatively reached a settlement. On October 13,
2011, Fall River fied a Notice of Withdrawal stating that the Facility had "determined it wil
pursue other alternative uses for the output of its qualifying facilty, and will not continue
discussions with Idaho Power Company or attempt to litigate the Complaint." Notice at 1.
Consequently, this case should now be closed.
