IPC-E-OWØ ) ) APPLICATION FOR APPROVAL ) OF DEFERRAL COSTS AND ) AMORTIZATION PERIOD ) ) Idaho Power Company ("Idaho Powet' or "Company"), in accordance with Idaho Code § 61-524 and RP 52, hereby respectfully makes Application to the Idaho Public Utilties Commission ("IPUC" or "Commission") for an accounting Order: (1) approving the deferral of costs associated with the Federal Energy Regulatory Commission ("FERC") order on Initial Decision, Docket No. ER06-787, and (2) authorizing the Company to amortize the deferral effective January 1, 2012. In support of this Application, Idaho Power represents as follows: i. BACKGROUND 1. On July 20, 2009, Idaho Power filed an Application for an Accounting Order requesting that the Commission authorize the deferral of costs associated with APPLICATION FOR APPROVAL OF DEFERRAL COSTS AND AMORTIZATION PERIOD - 1 e e the Company's transmission service based on transmission costs that were denied in a transmission rate case before the FERC (Docket No. ER06-787). The Company requested authority to defer the amount related to the difference between the forecasted third-party transmission revenues included in the Company's test years and those third- party revenues actually received until such time as the test year was updated and rates were changed, which occurred on June 1, 2010. 2. At that time, the Company estimated total unrecovered transmission revenues for the Idaho jurisdiction through May 31, 2010, would be $8,084,251 (see Attachment NO.1 to this Application). However, the Company acknowledged that it had contested issues with the FERC order, and was taking measures to address the issues, that if resolved, would reduce the deferraL. On October 30, 2009, Idaho Powets request for an Accounting Order authorizing the deferral of unrecovered transmission costs/revenues was granted. The Commission found an amortization period of three years was reasonable and authorized the amortization to begin January 1, 2011. Since then, Company actions have resulted in the need for a smaller than $8 milion deferraL. II. DEFERRAL ADJUSTMENTS 3. Idaho Powets primary contested issue with the FERC order was regarding the treatment of "Legacy Agreements," which are contracts for transmission service that contained their own terms, conditions, and rates and were in existence before implementation of the Open Access Transmission Tariff ("OATT") in 1996. In its Order on Initial Decision, FERC required Idaho Power to include the contract demands associated with the Legacy Agreements in the OA TT formula rate divisor rather than crediting the revenue from the Legacy Agreements against Idaho Powets transmission APPLICATION FOR APPROVAL OF DEFERRAL COSTS AND AMORTIZATION PERIOD - 2 e e revenue requirement. This created a gap where full recovery of the revenue requirement could not be achieved. At the time of the request, the Company had three Legacy Agreements, all with PacifiCorp, dating back as far as 1974. 4. On April 3, 2009, Idaho Power notified PacifiCorp that it was terminating its provision of a portion of the service that it provided under the Restated Transmission Service Agreement ("RTSA"), one of the Legacy Agreements, effective June 12, 2009. The FERC accepted revised rate schedules filed by the Company and on June 12, 2009, Idaho Power submitted a filng for the purpose of replacing the terminated contract service with OATT service effective June 13,2009. This change resulted in a decrease to the deferral of approximately $2.8 millon. Attachment No. 2 to this Application details the calculation of these additional OA TT revenues. 5. On June 19, 2009, the Company submitted a filng to increase rates under the Interconnection and Transmission Services Agreement ("ITSA"), another Legacy Agreement between Idaho Power and PacifiCorp. The filng requested an increase of rates to the level paid by OATT customers for point-to-point service and an August 19, 2009, effective date. On May 24, 2010, Idaho Power and PacifiCorp entered into and filed an offer of settlement with the FERC, which affrmed those rates. Under the settlement, PacifiCorp wil take and pay for 250 megawatts ("MW") of long-term point-to- point transmission service pursuant to the ITSA, with rate terms and conditions equivalent to Idaho Power's OATT. On July 23, 2010, the FERC issued an order approving the ITSA settlement effective August 19, 2009. This resulted in a decrease to the deferral of approximately $2.9 millon, as shown in Attachment No. 3 to this Application. APPLICATION FOR APPROVAL OF DEFERRAL COSTS AND AMORTIZATION PERIOD - 3 e e 6. On August 28, 2009, Idaho Power filed its informational filng with the FERC that contained the annual update of the formula rate based on the 2008 test year. The new rate included in the filng was $15.83/kW-year, an increase of $2.02 per kW- year. The new OATT rate was effective October 1, 2009. In the Company's initial deferral estimate, it held constant the OATT rate in effect at the time through May 31, 2010. The increase in the OATT rate effective October 1,2009, increased transmission revenues, decreasing the deferraL. 7. In September 2010, Idaho Power found an error in the calculation of the OATT formula rate for the 2006, 2007, and 2008 test years. The error resulted in an overstatement of the annual OA TT rate in effect from October 1, 2007, through September 30, 2010, ranging from $0.09/kW year to $0.24/kW year. The Company is in the process of calculating and issuing refunds to its OA TT customers. The errors in the OA TT formula rate overstated the Company's calculation of additional revenues received as a result of the termination of the RTSA as well as the calculation of additional ITSA revenues, described above in paragraphs 4 and 5. Attachment Nos. 4 and 5 to this Application detail the recalculation of the increased OA TT revenues related to the termination of the RTSA and the increase in the ITSA revenues as a result of the error in the OA TT formula rate. 8. In addition to impacting the additional revenues received based on changes to the RTSA and the ITSA, the corrected OA TT rates impacted the original deferral calculation. A lower OA TT rate increases the deferral as the difference between revenue credits used to offset the Company's revenue requirement in Case Nos. IPC-E-07-08 and IPC-E-08-10 and the actual revenues received are greater. APPLICATION FOR APPROVAL OF DEFERRAL COSTS AND AMORTIZATION PERIOD - 4 e e However, due to a higher than forecasted OATT rate effective October 1, 2009, (as described above in paragraph 6), revenues received from October 1, 2009, through May 31, 2010, were understated, thereby reducing the deferraL. Attachment NO.6 to this Application recalculates the deferral based on actual OA TT rates in effect from March 2008 through May 2010. The net change of the deferral based on the actual OA TT rates in effect is a $360,055 reduction. II. DEFERRAL QUANTIFICATION 9. Company actions and intervening events have allowed the Company to reduce the initial estimate of the deferral amount from $8,084,251 down to a total deferral of $2,064,469. Since the test year was updated June 1, 2010, to include the changes to third-party transmission revenues as a result of previous FERC orders, Idaho Power requests approval of the deferral amount related to the difference between the forecasted third-party transmission revenues included in the Company's test years and those third-party revenues actually received through May 2010. Idaho Power respectfully requests authorization of the deferral amount of $2,064,469 of unrecovered transmission revenues. APPLICATION FOR APPROVAL OF DEFERRAL COSTS AND AMORTIZATION PERIOD - 5 e e iv. AMORTIZATION 10. In their Order No. 30940, the Commission found that an amortization period of three years was reasonable and that the amortization period should begin on January 1, 2011. Prior to receiving Order No. 30940, the Company began settlement discussions and entered into a Stipulation committing that it would not file a general revenue requirement case which would result in a general rate adjustment to become effective prior to January 1, 2012. The Stipulation was approved by the Commission on January 13, 2010. Because the Stipulation does not allow the Company to recover the deferred transmission costs now, the Company is requesting to shift the beginning of the amortization period from January 1, 2011, to January 1, 2012, when the Company could potentially include the costs in rates. 11. Idaho Power does not request a determination of ratemaking treatment of the deferral with this filing and nothing in this Application wil impact the rates Idaho Power charges to customers at this time. Instead, Idaho Power proposed to address the ratemaking treatment and recovery of these costs in the Company's next general rate case application. v. MODIFIED PROCEDURE 12. Idaho Power believes that a hearing is not necessary to consider the issues presented herein and respectfully requests that this Application be processed under Modified Procedure, i.e., by written submissions rather than by hearing. RP 201 et seq. If, however, the Commission determines that a technical hearing is required, the Company stands ready to present its testimony and support the Application in such hearing. In order for Idaho Power to delay amortization of the deferral one year, it must have a Commission Accounting Order authorizing a modification to the current amortization schedule by the end of 2010.
