IPC-E-08-22 IN THE MATTER OF THE APPLICATION OF IDAHO POWER COMPAN FOR AUTHORn TO MODIFY ITS RULE H LINE EXTENSION TAR RELATED TO NEW SERVICE ATTACHMENTS AND DISTRUTION LINE INSTALLATIONS BUILDING CONTRACTORS ASSOCIATION OF SOUTHWESTERN IDAHO'S REQUEST FOR CONSIDERATION AND GRATING OF LATE-FIED REQUEST FOR INTERVENOR FUNDING The Building Contrctors Association of Southwester Idaho ("Building Contractors"), by and through its attorneys of record, Givens Puley LLP, and pursut to Idaho Code 61- 617A and IDAPA 31.01.01.161 - 165, respctfuly makes application to the Idao Public Utilities Commssion ("Commssion") for interenor fuding in the above-captioned matter. Ths application is late-filed. For the reans set fort below, however, Building Contrctors request that the Commssion exercise its discreton to waive the Commssion Rule 164 filing deadline, accept ths request as tiely filed, and grant Building Contrctors' request for interenor fuding. BUIING CONTRCTORS ASSOCIATION OF SOUTESTERN IDAHO'S REQUEST FOR CONSIDERATION AND GRATING OF LATE-FIED REQUEST FOR INVEOR FUING - Page i GROUNDS FOR LATE-FIING The reason for the Building Contrctor's late-filing of ths application is the inadverent and unintentional oversight by its legal counel with respe to the correct timig for submission of requests for interenor funding. Counsel for Building Contrors was under the misapprehension that such aplications would be fied after issuace of the Commission's decsion on the merts. This would have bee consistent with counsel's expeence in civil litigation and the assuption that the materality of Building Contractors' contrbution to the decsion rendered by the Commission would bet be discered by review of the decision itself. Counsel was mistaen. Commission Rule 164 requires filing of a reuest for interenor fuding no later than foureen. days after the last evidentiar heang or deadline for submittng briefs, proposed orders or statements of position. Although this matter was under modified procedures and interenors submitted comments as opposed to brefs, orders or statements of position, a strct reading of the rule would make the deadline for submttng ths request May 15, 2009, which was foureen days after the May 1 deadine for filing of reply comments. Building Contractors submit that whether to accept its late-filed interenor fudig request is a matter of the Commission's discetion. Idaho Code § 61-617A does not impose a jursdictonal deadline that would constrai the Commission's consideration of the Building Contractors' request, and the Idaho Supreme Cour has deeed the considertion of interenor fuding requests as a mater for the Commission's discetion. See Idaho Fair Share v. Idaho Public Utilities Commission, 113 Idaho 959, 751 P.2d 107 (1988). As discussed below, the Building Contrctors satisfy the crtera in I.C. § 61-617A and Commission Rule 165 for an award of interenor fuding. Building Contactors submt that neither Idaho Power Company ("Idaho Power" or the "Company") nor its ratepayer would be prejudice by considertion and BUIDING CONTRCTORS ASSOCIATION OF SOUTHWSTERN IDAHO'S REQUEST FOR CONSIDERATION AND GRATING OF LATE-FIED REQUEST FOR INTERVEOR FUING - Page i granting of this reuest, and that equity warants the same, given that ths late-filing was untentional. REQUEST FOR INERVENOR FUING 1. A sumar and itemized statements of the Building Contrctors' legal and consultant expenses for which it seeks recover is attched as Exhbit A. 2. The Building Contrctors' Develope's Council Subcmmttee and staffwere actively involved with legal counsel and Dr. Richard Slaughter in evaluating Idao Power's proposed changes to its line extension taff, and the economic impact thse changes would have on both the Building Contractors' member and the public in southwest Idaho. Although ths case involved only one set of tarffs, the factu and policy issues rased were complex and important. Dr. Slaughter was retained as the Building Contrors' consultant due to his famliarty with Idaho Power's rate strcte generally and its line extension tarff specificaly, havig testified before the Commission in Case No. IPC-E-95-18. Ths helped to reduce the time and expense required to establish a foundation of undertandig of the Rule H tarff, to analyze the proposed amendments and to generte reasoned comments for the Commission's considertion. Dr. Slaughter presented reasonable and factuly supprted arguents on the Building Contractors' behalf as to why the proposed realocation of costs for new distrbution was inconsistent with policies that promote more effcient use of energy and would have signficant adverse effects on the commercial and residential constrcton and real estate markets. Beyond merely crticig the propose tarff Dr. Slaughter offered reasonable alteratives for the Commission's consideration. Dr. Slaughter challenged the Staffs cacuations of Idaho Power's proposed investment in distrbution facilities. He argued that the proposed investment to see BUIING CONTRCTORS ASSOCIATION OF SOUTSTERN IDAHO'S REQUEST FOR CONSIDERATION AND GRATING OF LATE-FIED REQUEST FOR INTERVENOR FUDING - Page 3 new residential customers-approved by Staff-falls far short of the Company's invesent to sere existing residential customer for all but the smallest developments. Dr. Slaughter also distingushed the difference beteen inflation and growt as they affect Company costs. The Building Contractors' comments and testiony emphasized an issue of public policy affectng the general boy of electrc consumernamely the extent to which growt does or ought to pay for itself through electrc rates. Building Contractors urged the Commssion to look beyond the phre "growt should pay for itself," to inquire into the real causes of increased costs, and to crtically evaluate the extent to which new customer ar beig asked to pay more than existng customer, and whether such a policy encourges existing customer to consume more energy rather than consere it. No other par, including Staf addressed these issues squarely. In the end, the Commission did not agree with the Building Contractors' position. Its July 1st decision by and large accepts Idaho Power's proposed tarff as modified by Staffs recommendations. But neither the Commission's Rule nor the statute require the Commission to agree with an interenor in order to award them funding. The interenor fuding statute is intended to encourage partcipation in proceeings so that affected customer receive fair representation before the Commssion. Idaho Code § 61-617 A. A "prevailing par" stdad does not apply. Here, where the Building Contractors, though its comments and Dr. Slaughter's testimony, provided reasoned analysis for the alteratives it offered, and that analysis was different frm the Staffs, it must be assumed that Building Contractors contrbuted materally to this cae and to the Commission's decsion. The Building Contrctors' expes and costs incured in this cae, as suarzed in Exhibit A, tota $28,386.35.1 Ths includes $16,567.50 for legal fee (71.6 hours), $11,462.50 for consultant fees (65.3 hour) and $356.35 in copy charges. Thes expenses were reasonable and necessar. They include expenes incured to retrieve and review Commission files for the Company's last Rule H taff revision case that had bee moved to the State Archives. They also include time and expese reviewing comments, testiony and docuents submtted by other pares and the drftg of Building Contrctors' own testimony and comments. Ths time and effort peitted the Building Contrctors to meaingfully parcipate in these proceedings. 4. Building Contactors is a non-profit association that relies on volunta membeship and voluntar contrbutions to fud its operations and promote the interests of its member builders, contractors and developers. All of the Building Contractors' operations expenses, includig building, employees, membe mailings and parcipation in legal or adminstrtive proceedings such as this case, ar paid from thes voluntar contrbutions. The costs and expees sumarzed in Exhbit A have bee a signficant financial burden for Building Contrctors. Curently, voluntar contrbutions have dropped signficantly due to the strggling ecnomy generly and the depesse local real estate sector spfically. Because of the reuctions in Building Contrctors' income, it rectly has had to impose signficant budget cuts an mandatory days off for its staf. Building Contractors continues to solicit membe contrbutions to cover its generl operating costs and the costs of its interention in this proceeing. Buidig Contrctors reognes tht Idao Code § 61-617 A limts the amount awable as inteenor fuding to $25,000. BUIDING CONTRCTORS ASSOCIATION OF SOUTSTERN IDAHO'S REQUEST FOR CONSIDERATION AND GRTING OF LATEFIED REQUEST FOR INTERVENOR FUING - Page 5 The Commssion previously recognzed Building Contractors as eligible for interenor fudig in Case No. IPC-E-95-18 (involvig a Rule H Tarffamendment), where the Buildig Contrctors incued $14,250.00 in legal fees and $12,207.50 in consultant fees. There the Commssion authorized interenor fuding in the maximum statutory amount of $25,00 payable from rates charged to the class that it deemed was prmarly benefitted-namely, lots withn subdivisions that require line extenions. Building Contractors submits that its appance in this case was for the benefit of owner oflots within commercial and residential subdivisions requirig line extensions. CONCLUSION Ths reuest for interenor fuding is late-fied.given a strct application of Commission Rule i 64, which reuires such applications to be filed withn fouree days of the filing of the last bref (or, in ths case, comments). It has, however, been filed withn foureen. days of the Commssion's issuce of its Order in this case and at the ealiest opprtity after counsel's discover of the actu dealine. The costs that Building Contrctors have incued are reasonable given its substantial level of effort and parcipation in these proceedings. These costs wer incued to advance policies that benefit Building Contrctors' membe and the public at large. Building Contractors have materally contrbuted to the decision in ths case and to the public debate about issues of populaton growt an energy costs. Parcipation in ths case has be, and cotinues to be, a financial hardship for Bulding Contractors. Building Contrctors and its legal counsel reues that the inadverence of misapprehending the filing deadline should not result in fuer financial harship, and they respecfully request that the Commission exercise its broad discreton to accept and grt this reues for interenor fuding, to be paid frm the class of customer priarly affected and BUIDING CONTRCTORS ASSOCIATION OF SOUTSTERN IDAHO'S REQUEST FOR CONSIDERATION AN GRTING OF LATE-FIED REQUET FOR INTERVENOR FUING - Page 6 benefitted-namely, lots withn subdivisions that require line extensions.
