COMES NOW, Glenns Ferry Cogeneration Partners, Ltd. ("Respondent"I"Glenns
Ferry Cogeneration"), by and through undersigned counsel, and files this Motion to Stay
Discovery pursuant to Rule 56 of the Idaho Public Utilities Commission's Rules of
Procedure.
PROCEDURAL BACKGROUND
On October 16, 2008, Idaho Power Company filed a "Petition for Declaratory
Order and Formal Complaint for Breach of Contract" (herein "Complaint") with this
Commission. Idaho Power served its "First Set of Interrogatories to Glenns Ferry

Cogeneration Partners, Ltd." and it's "First Request for Production of Documents to
Glenns Ferry Cogeneration Partners, Ltd." on or about October 29,2008. Glenns Ferry
Cogeneration filed a Motion to Dismiss for Lack of Subject Matter Jurisdiction on
Monday, November 10,2008.
MOTION TO STAY DISCOVERY
Because Glenns Ferry Cogeneration believes that the Commission lacks
subject matter jurisdiction over Idaho Power's Complaint, Glenns Ferry likewise believes
that the Commission is not the proper forum for conducting Discovery between the
parties and, therefore, Idaho Power's Discovery is untimely and without a legal basis.
Wherefore, Glenns Ferry prays the Commission to issue an interim order
staying all Discovery between the parties pending the Commission's ruling on Glenns
Ferry's Motion to Dismiss for Lack of Subject Matter Jurisdiction.
