Telford, hereby petitions the Idaho Public Utilities Commission (IPUC) for limited admission of the undersigned applying counsel, Arur Perr Bruder, and to excuse Mr. Telford from attendance at all proceedings before it in the above-captioned matter. . This Motion is made pursuant to Idaho Bar Commission Rule (mCR) 222 and Rule 19 of the IPUC Rules of Procedure for the purose of the above-captioned matter. Applying counsel certifies that he is an active member in good standing of the bar of the State of New York, that he maintains the regular practice of law as an attorney in the Offce of the General Counsel of the United States Deparent of Energy ("the Deparent") at the above-noted address, and t~at he is neither a resident of the State of Idaho nor licensed to practice in Idaho. IPC-E-08-10 OF IDAHO POWER COMPAN FOR ) AUTHORITY TO INCREASE ITS RATES ) MOTION OF AND CHAGES FOR ELECTRIC SERVICE ) THE UNITED STATES TO ELECTRIC CUSTOMERS IN THE ) DEPARTMENT OF ENERGY STATE OF IDAHO ) FOR LIMITED ADMISSION AND ) TO EXCUSE LOCAL COUNSEL ORDER GRANTING MOTION OF THE UNITED STATES DEPARTMENT OF ENERGY FOR LIMITED ADMISSION AND TO EXCUSE LOCAL OCUNSEL On or about July 29, 2008, Stephen Telford, local counsel, filed a Motion ("the Motion") with the Idaho Public Utilities Commission ("Commissionll) for limited admission of Arur Perr Bruder in the above-captioned proceeding, (Reference: Idaho Bar Commission Rule ("IBCR") 222; IPUC Rule of Procedure 19) and to excuse Mr. Telford from attendace at all proceedings before it in the above-captioned matter. Mr. Bruder certifies that he is an active member in good standing of the New York State Bar and that he maintains the regular practice of law as an attorney in the Office of the General Counsel of the United States Deparent of Energy (lithe Deparent") at 1000 Independence Avenue SW, Washington, DC. Mr. Bruder fuher certfies tht he is not a resident of the State of Idaho, that he is not licensed to practice in Idaho, and that he has not previously sought admission under mCR 222 or Rule 19 of the IPC Rules of Procedure. Both Mr. Telford and Mr. Bruder certfy that a this Motion has been electronically served on all other paries to this proceeding, that a copy of this Motion has been provided to the Idaho State Bar, and that the Deparent's Idaho Operations Office is aranging to transmit, and shall within the next two weeks transmit, the necessary $200 fee to the Idaho State Bar. Mr. Telford requests that the Commission excuse him from attendance at the proceedings before the Commission in this matter. COMMISSION FININGS The Commission has reviewed and considered the Motion of the United States Deparent of Energy for Limited Admission and to Excuse Local Counsel in the above-captioned proceeding, and the related practice rules and Rules of Procedure, i.e., mCR 222 (Limited Admission - Pro Hac Vice) and Commission Rule of Procedure 19, IDAPA 31.01.01.019. Based on the filings of record and certified representations of Mr. Telford and Mr. Bruder, we find that reasonable grounds have been demonstrated to justify the grting of limited admission of Mr. Bruder as legal counsel for the United States Deparent of Energy in the above-captioned proceeding. We fuher find it reasonable to excuse Mr. Telford from attendance at the proceedings before the Commission in this matter. CONCLUSIONS OF LAW The Commission has jursdiction in the above-captioned proceeding and in regard to the Motion for Limited Admission and to Excuse Local Counsel fied by Stephen Telford, local counsel, and Arhur Perr Bruder, applying counsel, pursuant, to Idao Code, Title 61, and Rule 19 of the Commission's Rules of Procedure, IDAPA 31.01.01.000 et seq. In consideration of the foregoing and as more parcularly described above, IT IS HEREBY ORDERED that Arur Perr Bruder is granted limited admission in Case No. E-08-10 as legal counsel for the United States Deparent of Energy, and that Stephen Telford is excused from attendance at the proceedings before the Commission in this matter.
