At the hearing on Wednesday, January 23, 2008, counsel for Kroger
reserved the right to file a post-hearing brief on the issue of a Schedule 9 time-of-
use rate. Counsel told the Commission that Kroger wil decide whether it wil file a
brief shortly after the hearing. After considering this matter, Kroger does not wish
to file a brief on this issue.
