Commissioners:
I recommend the commission urge the parties to resolve this case so that importantly--the
contract is upheld --versus the consideration of addressing the following public policy
issues:
1. jobs--economic development--in a very depressed area 2. renewable power production in the
right place on the grid 3. biomass fuel utilization (which is very complimentary to
sustainable timber production) and maybe most importantly forest health including fire
prevention.
Hopefully the parties will resolve the issue--otherwise--- Good luck!!

I assume that Yellowstone Power will pay the nonperformance damages with private funds. If
that is so, all parties concerned are to be congratulated for operating in a responsible
manner. And the Ada County Commissioners responsible for the contract with Dynamis LLC should
learn a lesson from this case as to how public-private interactions should be handled.
