RESPONDENT.
On April 15 , 2010, the New Energy Company LLC (New Energy) and Western
States Equipment Company, Inc. (Western States) filed a "grandfathering" complaint against
Idaho Power Company (Idaho Power; Company) claiming entitlement to published avoided cost
rates established in Idaho Public Utilities Commission (Commission) Order No. 30744. The
published rates of Order No. 30744 were superseded by lower rates on March 16 2010, in Order
No. 31025.
On April 16, 2010, the Commission caused to be issued a Summons in Case No.
IPC-lO-13 directing Idaho Power to file a written answer or motion in defense of said
complaint within 21 days, i., May 7, 2010.
Pursuant to Joint Motion of the parties filed on May 7 2010, the parties request that
Idaho Power be granted an additional 30 days to file its answer to New Energy s complaint in
this proceeding. The parties agree that Idaho Power s answer shall now be filed on or before
June 7, 2010, unless otherwise agreed to by the parties or Order by the Commission.
COMMISSION FINDINGS
A Joint Motion has been filed by respondent and complainants in Case No. IPC-
10-13 requesting a 30-day extension oftime for Idaho Power to file its answer to the complaint
in this proceeding. YOU ARE HEREBY NOTIFIED that the Commission finds good cause to
grant the Joint Motion for extended time to file an answer.
YOU ARE FURTHER NOTIFIED that the extended answer deadline for Idaho
Power to the Summons issued in Case No. IPC-lO-13 is June 7, 2010.
