HomeMy WebLinkAbout20100723Decision Memo.pdfDECISION MEMORANDUM 1 DECISION MEMORANDUM TO: COMMISSIONER KEMPTON COMMISSIONER SMITH COMMISSIONER REDFORD COMMISSION SECRETARY COMMISSION STAFF LEGAL FROM: NEIL PRICE DEPUTY ATTORNEY GENERAL DATE: JULY 22, 2010 SUBJECT: IDAHO POWER COMPANY’S APPLICATION FOR A PRUDENCY DETERMINATION OF ENERGY EFFICIENCY RIDER FUNDS SPENT DURING 2008-2009, CASE NO. IPC-E-10-09 On March 16, 2010, Idaho Power Company (“Idaho Power” or “Company”) filed an Application with the Commission seeking an Order designating Idaho Power’s expenditures of $50,701,740 in Energy Efficiency Rider (“Rider”) funds in 2008 and 2009 as prudently incurred expenses. On June 25, 2010, the Commission issued a Notice of Application and Intervention Deadline establishing a July 9, 2010, deadline for prospective parties to file Petitions to Intervene in this matter. See Order No. 32019. On June 28, 2010, the Idaho Conservation League (“ICL”) filed a Petition to Intervene. On July 8, 2010, the Idaho Irrigation Pumpers Association, Inc. (“IIPA”) filed a Petition to Intervene. Both parties, ICL and IIPA, claim a direct and substantial interest in the above- captioned proceedings and state that their participation as a party would include the following: present evidence, call and examine witnesses, cross-examine witnesses, present argument, and to otherwise fully participate in the proceedings. Further, ICL and IIPA state that their participation as a party is necessary in order to adequately represent their interests. ICL and IIPA have not formally requested a hearing in this matter. DECISION MEMORANDUM 2 STAFF RECOMMENDATION Staff recommends that the Commission process Idaho Power’s Application through Modified Procedure and establish a 45-day comment period. COMMISSION DECISION 1. Does the Commission wish to approve the Petitions to Intervene filed by ICL and IIPA? 2. Does the Commission wish to process Idaho Power’s Application through Modified Procedure with a 45-day comment period? M:IPC-E-10-09_np
