Re: Micron Technology, Inc., Contract Demand Level
Dear Mr. Velikoff:
I am in receipt of your letter of January 10, 2012, wherein Micron Technology, Inc.
("Micron") has requested an increase to its monthly Contract Demand from 60
megawatts ("MW") to 68 MW effective as of April 1, 2012. Idaho Power Company
("Idaho Power") is pleased to accommodate this request.
Pursuant to the Agreement for Electric Service Between Idaho Power Company
and Micron Technology, Inc., dated December 29, 2009 ("Agreement"), Micron may
request an increase to its Contract Demand above 60,000 kilowatts ("kW") in even
1,000 kW increments up to a total maximum Contract Demand of 120,000 W.
Agreement § 6.2(a). The Agreement further provides that upon Idaho Power granting
Micron a new Contract Demand amount, such new Contract Demand shall be in effect
for a minimum of at least six (6) months. Id.
Per your request, Micron's new Contract Demand under the Agreement shall be
68 MW effective April 1, 2012, and shall continue until at least October 1, 2012. Idaho
Power shall continue to provide a Contract Demand of 68 MW to Micron subsequent to
October 1, 2012, unless and until Micron provides notice that it desires to decrease
and/or increase its Contract Demand in accordance with the Agreement. See Sections
6.2(a) and 6.2(b).
To confirm this mutual understanding, please have an authorized individual from
Micron counter-sign both copies of this letter, keep one copy for your records, and
