COMES NOW, Idaho Power Company ("Idaho Powet' or "Company") and
hereby requests that the Commission extend the date for filng Reply Comments in this
case. Order No. 31010, the scheduling order, currently allows Reply Comments to be
filed within ten days after the initial comment period. The initial comment period ended
on March 25,2010. As a result, Reply Comments would be due on April 5, 2010. Idaho
Power is requesting an additional four days, until April 9, 2010, to file its Reply
Comments.
IDAHO POWER COMPANY'S MOTION FOR EXTENSION OF TIME TO FILE REPLY COMMENTS - 1
Idaho Power makes this request based on the following:
1. Commission Staff, Idaho Conservation League, Community Action
Partnership Association of Idaho, and AARP all filed extensive Comments. In total, their
Comments exceed fort pages. Because of the volume and complexity of the issues
raised by Staff and Intervenors, it wil take longer than the ten days allowed in Order No.
31010 for the Company to prepare and file adequate Reply Comments.
2. None of the Intervenors argue that the FCA should be discontinued. As a
result, a very short delay in the filng of the Reply Comments wil not impact the timing of
the implementation of fixed cost adjustment rates, which is the subject of a separate
case, IPC-E-10-07, filed by the Company on March 15,2010.
3. Idaho Power has contacted counsel for Staff, CAPAI, and ICL, and the
Company is authorized to advise the Commission that these Intervenors do not object
to the extension. Idaho Power was unable to contact the Snake River Allance.
Based on the foregoing, Idaho Power requests that the Commission issue its
order allowing Reply Comments to be filed in this case on or before April 9, 2010.
