HomeMy WebLinkAbout20090603intervention_order_no_30831.pdfOffice of the Secretary Service Date June 3 , 2009 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF IDAHO POWER COMPANY'S APPLICATION FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY FOR THE LANGLEY GULCH POWER PLANT ORDER NO. 30831 CASE NO. IPC-09- Community Action Partnership Association of Idaho (CAP AI) petitioned to intervene in this case on June 1 , 2009, after the deadline for petitioning to intervene of April 1 , 2009 pursuant to Rules of Procedure 71 through 75 of the Idaho Public Utilities Commission, IDAP A 31.01.01.071-075. CAP AI commits that if it were allowed intervenor status, it would not unduly broaden the scope of the case. Furthermore, CAP AI offers the assurance that it will not file any motions or seek any relief from the Commission that would result in backtracking or stalling the progress of this case. CAP AI also assures the Commission that, if granted intervention, it will strictly adhere to all future deadlines. FINDINGS OF FACT We find that based on the pleadings and other documents filed in this case intervention by this party would serve the purposes of intervention as described by Rule 74 of the Rules of Procedure. We also find that granting this late intervention will not prejudice any party and that late intervention should be granted. ORDER IT IS THEREFORE ORDERED that the Petition to Intervene filed by the Community Action Partnership Association of Idaho is hereby granted. IT IS FURTHER ORDERED that all parties in this proceeding serve all papers hereafter filed in this matter on all parties of record.
