IPC-E-08-10 ) ) JOINT MOTION FOR APPROVAL OF ) ENERGY EFFICIENCY RIDER ) PRUDENCY STIPULATION COME NOW, Idaho Power Company ("Idaho Power" or the "Company) and the Idaho Public Utilities Commission Staff ("Staff') and hereby move, the Commission pursuant to RP 56 and 256 to approve the enclosed Stipulation addressing the prudency expenditures of Energy Efficiency Rider ("Rider") funds spent between 2002 and 2007. This Joint Motion is based on the following: JOINT MOTION FOR APPROVAL OF ENERGY EFFICIENCY RIDER PRUDENCY STIPULATION - 1 1. In testimony 1 spread throughout the technical hearing record on December 16-19, 2008, Idaho Power requested that the Commission explicitly find that its expenditures of funds obtained from the Energy Effciency Rider during the 2002- 2007 period were prudently incurred. The Commission Staff presented testimonl recommending that the Commission defer a prudency determination for Idaho Power's Rider expenses until the Company was able to provide a comprehensive evaluation package of its programs and efforts. Idaho Power contended that information suffcient to make the prudency determination existed and had been provided or made available for Staff review. 2. Idaho Power and the Commission Staff have reached agreement regarding the prudency of a portion of the $28,961,716 in Rider funds Idaho Power spent between 2002 and 2007. As described in the Stipulation, the Parties agree that $14,303,745 in rider-funded expenses associated with twelve programs is prudently incurred. This amount includes $2,160,878 in Rider funds paid to NEEA from 2005- 2007. 3. To date, no Part has suggested that any energy effciency program or associated expenditure made since 2002 and collected under rate Schedule 91 is imprudent. The Company and Staff wil continue to exchange information and discuss settlement with regard to the remaining $14,657,971 over the next several months. On or before April 1, 2009, Idaho Power wil file a pleading with the Commission seeking a prudency determination of the balance of Rider funds spent during 2002-2007. JOINT MOTION FOR APPROVAL OF ENERGY EFFICIENCY RIDER PRUDENCY STIPULATION - 2 Rider expenditures cannot be reached, Staff and Idaho Power wil recommend additional procedure to allow the Commission to make such a determination. NOW, THEREFORE, Idaho Power and the Commission Staff respectfully request that the Commission issue a final order approving, without material change or condition, the enclosed Stipulation regarding prudency determination of Energy Effciency Rider funds spent between 2002 and 2007.
