IPC-08- ) NOTICE OF APPLICATION - r - - - _ n n - - NOTICE OF MODIFIED PROCEDURE ) ORDER NO. 30570 - -- - NOTICE OF APPLICATION YOU ARE HEREBY NOTIFIED that on April 28, 2008 , Idaho Power Company Idaho Power" or "Company ) filed an Application with the Commission seeking approval of its Firm Energy Sales Agreement ("Agreement") with DF-AP #1 LLC ("DF-AP" YOU ARE FURTHER NOTIFIED that the parties entered into the aforementioned Agreement on April 21 , 2008. YOU ARE FURTHER NOTIFIED that the Agreement states that Idaho Power shall purchase a specified amount of electric energy generated by the Big Sky West Dairy Digester Generation Facility ("Big Sky ) near Gooding, Idaho. YOU ARE FURTHER NOTIFIED that the Big Sky facility qualifies as a small power production facility under the applicable provisions of the Public Utility Regulatory Policies Act of 1978 ("PURP A") and will provide a total of 1.5 MW of nameplate generation. YOU ARE FURTHER NOTIFIED that the Agreement was entered into pursuant to the terms and conditions of prior Commission Orders; will have a 20-year term of effectiveness; utilizes the non-Ievelized published avoided-cost rates established by the Commission for energy deliveries of less than 10 average MW; and will be effective only once all of its terms and conditions are approved by the Commission as allowable expenses for ratemaking purposes. YOU ARE FURTHER NOTIFIED that DF-AP will begin delivering energy to Idaho Power s system on November 21 , 2008 and has set apart February 14, 2009 as its Scheduled Operation Date. NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO. 30570 YOU ARE FURTHER NOTIFIED that DF-AP must meet certain requirements and preconditions under the Agreement before Idaho Power is obligated to accept any energy deliveries from DF-AP and that Idaho Power agrees to monitor for compliance with these terms. YOU ARE FURTHER NOTIFIED that all applicable interconnection charges and monthly operation and maintenance charges under Schedule 72 will be assessed to DF-AP and administered by Idaho Power s delivery business unit. NOTICE OF MODIFIED PROCEDURE YOU ARE FURTHER NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter and will proceed under Modified Procedure pursuant to Rules 201 through 204 of the Idaho Public Utilities Commission s Rules of Procedure IDAPA 31.01.01.201 through .204.The Commission notes that Modified Procedure and written comments have proven to be an effective means for obtaining public input and participation. YOU ARE FURTHER NOTIFIED that any person desiring to state a position on this Application may file a written comment in support or opposition with the Commission within twenty-one (21) days from the service date of this Notice. The comment must contain a statement of reasons supporting the comment. Persons desiring a hearing must specifically request a hearing in their written comments. If written comments are received within the time limit set, the Commission will consider them and, in its discretion, may set the same for formal hearing. YOU ARE FURTHER NOTIFIED that the Application has been filed with the Commission and is available for public inspection during regular business hours at the Commission offices. The Application is also available on the Commission s Website at www.puc.idaho.gov and then clicking on "File Room" and then "Electric Cases. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission s jurisdiction under Title 62 of the Idaho Code and specifically Idaho Code ~~ 62-615(i). The Commission may enter any final Order consistent with its authority under Title 62. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission s Rules of Procedure, IDAPA 31.01.01.000 et seq. ORDER IT IS HEREBY ORDERED that this Application will be processed under Modified Procedure. Persons interested in submitting written comments regarding this case or protesting the use of Modified Procedure should do so no later than 21 days from the service date of this Order.
