IPC-07- On January 18, 2008 , Idaho Power Company filed a Motion to Withdraw Petition in this case. The Motion states that one of the joint petitioner individuals is no longer associated with the development and the proposed development is being reconfigured. The petitioners plan to re- file a petition requesting a master-metering rule exemption when new plans are finalized. Commission Rule of Procedure 68 provides that a party may withdraw a pleading by filing a notice of withdrawal with the Commission. Unless otherwise ordered by the Commission, a notice of withdrawal is effective 14 days after filing. Although Idaho Power styled its pleading as a Motion, it serves the same purpose as a notice of withdrawal under Rule 68. Accordingly, although the Commission approves the Motion filed by Idaho Power, the notice provided by Idaho Power was effective as of February 1 , 2008 and the petition is regarded as withdrawn. This case can be closed and a new docket opened when a new petition is filed. DATED at Boise, Idaho this ,;2d-.J.. day of February 2008. J.~ MARSHA H. SMITH, COMMISSIONER ATTEST: bls/O:IPC-O7-12 ws2
