IPC-07- APPLICATION COMES NOW , Idaho Power Company ("Idaho Power" or "the Company ) and pursuant to RP 52 hereby applies to the Idaho Public Utilities Commission ("IPUC or the Commission ) for an Order approving an agreement, dated April 17, 2007, for continuation of electric service between Idaho Power and the United States Department of Energy ("DOE"), acting through its Idaho operations office. This Application is based upon the following: The United States Department of Energy, through its Idaho operations office operates the facilities at the Idaho National Laboratory Site located approximately 50 APPLICATION - miles west of Idaho Falls, Idaho. DOE and its predecessors have been customers of Idaho Power for many years. Idaho Power supplies electric service to DOE under a special contract, in accordance with the rates and charges set out in Electric Service Rate Schedule 30 ("Schedule 30") and its successor schedules. II. On May 8, 2006, in Order No. 30030 issued in Case No. IPC-E06-, the Commission approved a special contract, between Idaho Power and DOE , with an initial term running from May 15 , 2006 through May 14, 2007 ("2006 Agreement" ). The 2006 Agreement gives DOE the option to request up to four, one-year extensions of the 2006 Agreement. Following negotiations, Idaho Power and DOE have agreed to extend the 2006 Agreement for one year with a term of service running from May 15 , 2007 through May , 2008, (the "2007 Extension Under the 2007 Extension , electric service provided under Rate Schedule 30 and , therefore, the rates and charges for providing service under the 2007 Agreement are subject to change in any appropriate ratemaking proceeding. If approved by the Commission , the 2007 Extension would remain in effect for one year, through May 14 , 2008, with the possibility of additional extensions in accordance with Section 1 of the 2006 Agreement or the possibility of termination for the convenience of the DOE in accordance with the provisions of Section 3 of the 2006 Agreement.Termination under Section 3 requires written notice and provides for termination for conveniences charges if notice of termination is given less than months prior to scheduled expiration. APPLICATION - 2 III. Enclosed with this Application is a copy of the 2007 Extension. Because the initial term of the 2006 Agreement expires on May 14, 2007 , Idaho Power requests that the Commission process this application on an expedited basis and approve the continuation of the initial term of the 2006 Agreement to run until the 2007 Extension is approved. NOW , THEREFORE BASED ON THE FOREGOING , Idaho Power hereby requests that the Commission issue its order (1) approving the 2007 Extension for electric service between Idaho Power and the United States Department of Energy; and (2) approving the continuation of the initial term of the 2006 Agreement until the Commission issues its order approving the 2007 Agreement.
