A VU-07- REVISING A VISTA CORPORATION' OBLIGATIONS TO ENTER INTO CONTRACTS TO PURCHASE ENERGY GENERATED BY WIND-POWERED SMALL POWER GENERATION FACILITIES IN THE MATTER OF IDAHO POWER COMPANY'S PETITION TO INCREASE CASE NO. IPC-07- THE PUBLISHED RATE ELIGIBILITY CAP FOR WIND-POWERED SMALL POWER PRODUCTION FACILITIES; AND TO ELIMINATE THE 90%/110% PERFORMANCE BAND FOR WIND- POWERED SMALL POWER PRODUCTION FACILITIES IN THE MATTER OF THE PETITION OF ROCKY MOUNTAIN POWER FOR CASE NO. PAC-07- ORDER REVISING CERTAIN OBLIGATIONS TO ENTER INTO CONTRACTS TO PURCHASE ENERGY GENERATED BY WIND-POWERED SMALL POWER GENERATION QUALIFYING ORDER NO. 30470 FA CILITIES On November 23, 2007, Avista Corporation dba Avista Utilities caused to be filed with the Idaho Public Utilities Commission (Commission) a Motion for the Limited Admission of Michael G. Andrea in Case Nos. A VU-07-, IPC-07-, and P AC-07-07 (reference Idaho Bar Commission Rule 222; IPUC Rules of Procedure 19 and 43.05). The local Idaho counsel filing the Motion is Jerry K. Boyd (ISB No. 1341), Paine Hamblen LLP, 717 West Sprague, Suite 1200, Spokane, Washington 99201-3505. Michael G. Andrea certifies that he is an active member in good standing with the Bars of the State of Washington and Oregon and that he maintains a regular practice of law at Avista Corporation, 1411 East Mission Avenue, MSC-, Spokane, Washington 99202. Mr. ORDER NO. 30470 Andrea further certifies that he is not a resident of the State of Idaho or licensed to practice in Idaho and that he has not previously sought admission under IBCR 222. Both Mr. Andrea and local counsel, Mr. Boyd, certify that a copy of the respective Motion, accompanied by a $200 fee, has been provided to the Idaho State Bar. Mr. Boyd acknowledges that as local counsel, his attendance shall be required at all proceedings before the Commission in which Mr. Andrea appears, unless specifically excused by the Commission. In this regard, Mr. Boyd respectfully requests that the Commission excuse him from having to appear during Commission proceedings in the above captioned matters. Commission Findings The Commission has reviewed and considered the Motions for Limited Admission filed in Case Nos. A VU-07-, IPC-07-, and PAC-07-07 and the related practice rules and Rules of Procedure, i., Idaho Bar Commission Rule 222 (Limited Admission - Pro Hac Vice) and Commission Rul6s of Procedure 19 and 43., IDAPA 31.01.01.019 and 043.05. Based on the filings of record and certified representations of Mr. Andrea and Mr. Boyd, we find that reasonable grounds have been demonstrated to justify the granting of limited admission of Mr. Andrea as legal counsel for A vista Corporation dba A vista Utilities in Case Nos. A VU-07-, IPC-07-, and PAC-07-07. We further find good reason to excuse the appearance of Mr. Boyd in further proceedings in those dockets. CONCLUSIONS OF LAW The Commission has jurisdiction in Case Nos. A VU-07-, IPC-07-, and PAC-07-07 and the Motion for Limited Admission filed by Jerry K. Boyd, local counsel, and Michael G. Andrea, applying counsel , pursuant to Idaho Code, Title 61 , and the Commission Rules of Procedure, 31.01.01.000 et seq. ORDER In consideration of the foregoing and as more particularly described above, IT IS HEREBY ORDERED and Michael G. Andrea is hereby granted limited admission in Case Nos. A VU-07-, IPC-07-, and PAC-07-07 as legal counsel for the applicant, Avista Corporation dba A vista Utilities. IT IS FURTHER ORDERED that the attendance of Jerry K. Boyd is excused from all further proceedings in Case Nos. A VU-07-, IPC-07-, and PAC-07-07.
