Box 83720 Boise, Idaho 83720-0074 Re: Case No. IPC-E-06-34, Hot Springs Wind Farm and Case No. IPC-E-06-35, Bennett Creek Wind Farm Dear Ms. Jewell: In Order No. 30453 issued by the Commission on October 17,2007, in the above- referenced cases, the Commission approved generation interconnection agreements for the Hot Springs and Bennett Creek wind farms. Enclosed with this letter is a letter agreement between Idaho Power Company ("Idaho Powet') and John Deere Wind Energy, which has acquired the Bennett Creek and Hot Springs wind farms. The letter agreement confirms that the capacity of the BennettHot Springs projects is approximately 2 MWs greater than the capacity amounts indicated in the above-referenced cases. Idaho Power is providing this letter agreement to the Commission for informational purposes. Because the additional 2 MW of capacity is not material, Idaho Power is not requesting that the Commission take any action in response to this letter. Very truly yours,~d. Barton L. ANGELL Manager, Delivery Planning October 23, 2009 Terry Kramer Manager, Wind Administration John Deere Wind Energy 6400 Northwest 86th Street P.O. Box 6650 Johnston, Iowa 50131-6650 Re: Bennett Creek and Hot Springs Wind Farm Dear Mr. Kramer: Representatives of our two companies have been discussing certain updates to the generation interconnection agreements ("GIAs") dated September 13, 2007, between Idaho Power Company ("Idaho Powet' or the "Company") and Hot Springs Wind Farm, LLC ("Hot Springs"), and Bennett Creek Wind Farm, LLC ("Bennett Creek"). In Order No. 30453 issued by the Idaho Public Utilties Commission ("Commission") on October 17, 2007, in Case No. IPC-E-06-34 and Case IPC-E-06-35, the Commission approved the above-referred GIAs. On December 13,2007, Idaho Power was notified by John Deere Wind Energy that John Deere Renewables, LLC ("John Deere") had purchased one hundred percent of the rights, obligations, and interests in Hot Springs and Bennett Creek. This letter also confirmed that the megawatt output of the Bennett Creek/Hot Springs projects would be increased from 39.6 megawatts to 41.6 megawatts. Idaho Power had received this request for the additional 2 megawatts of capacity prior to the change in ownership described above and the additional two megawatts had been studied and accepted under the generation interconnection process (GI Nos. 195 and No. 196). Based on the foregoing, this letter will confirm the agreement between the Company and John Deere as follows: 1. Idaho Power accepts and acknowledges that John Deere is the customer under the Bennett Creek/Hot Springs GIAs; and P.O. Box 70 (83707) 1221 W. Idaho St. Boise. ID 83702 Terry Kramer October 23, 2009 Page 2 2. Idaho Power acknowledges that the combined capacity of the Bennett Creek/Hot Springs projects is 41.6 megawatts. It is the intention of the Company to send a copy of this letter agreement to the Commission for inclusion in the Commission's records. The Company does not intend to ask the Commission to review and approve the above-referenced changes to the Generation Interconnection Agreements filed in Cases IPC-E-06-34 and IPC-E-06-35. If you concur that the foregoing accurately reflects the agreement of the parties, please confirm your agreement by signing all three copies of this letter in the space provided below and return two fully executed copies to me. ~/ David M.
