On September 14, 2007, Avimor, LLC filed a timely Notice of Appeal from Order Nos. 30322 and 30396 in Case No. IPC-06-23. Idaho Appellate Rule 6 provides in an appeal from an Order of the Commission filed by an intervenor, in this case Avimor, that the petitioner or applicant in the original proceedings shall be made a party to the appeal and designated as a respondent. Avimor in its Notice of Appeal did not identify Idaho Power Company, the applicant in the original proceeding, as a respondent on appeal. Idaho Appellate Rule 6 also provides that the Commission "may by order correct the title of an appeal or cross-appeal at any time before the clerk's or agency s record is lodged" with the Supreme Court. Accordingly, the Commission issues this Order to correct the title to designate Idaho Power Company as a respondent on appeal. IPUC ORDER NO. 30448 ORDER IT IS HEREBY ORDERED that the title of the appeal in this matter shall be corrected as reflected above to include Idaho Power Company as Respondent on appeal. IT IS FURTHER ORDERED that the Commission Secretary shall file a copy of this Order with the Supreme Court.
