IPC-06- NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO. 30149 YOU ARE HEREBY NOTIFIED that on September 18, 2006, Idaho Power Company filed an Application requesting approval of changes to its Irrigation Peak Rewards Program, Schedule 23. The Irrigation Peak Rewards Program is a voluntary load control program available to agricultural irrigation customers who use pumps having a cumulative horsepower rating of 100 or greater. The program is intended to decrease the Company summer system peak by turning off specified irrigation equipment between the hours 4:00 p. and 8:00 p.m. on one, two or three days per week during the months of June, July and August. The Commission in Case No. IPC-05-28 encouraged Idaho Power to conduct a workshop with interested parties to determine whether revisions to the program would be appropriate. As a result of the workshop, Idaho Power filed its Application to revise the program. YOU ARE FURTHER NOTIFIED that Idaho Power proposes to make two revisions to the program. First, the demand credit for the two days per week and three days per week interruptions would be increased, as set forth in the following schedule: Interruption Option Option 1 (1 day per week) Option 2 (2 days per week) Option 3 (3 days per week) Current Demand Credit per kW $2. $2. $2. Proposed Demand Credit per kW $2. $3. $4. The second revision is to reduce the horsepower limit to make the program available to irrigators using pumps rated at 75 horsepower or higher. An installation fee of $250 would be assessed for new program participants with irrigation pumps between 75 and 99 horsepower if it is necessary to install a timer on the pumps. NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO. 30149 YOU ARE FURTHER NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter and will proceed under Modified Procedure pursuant to Rules 201 through 204 of the Idaho Public Utilities Commission s Rules of Procedure IDAP A 31.01.01.201 through .204. The Commission notes that Modified Procedure and written comments have proven to be an effective means for obtaining public input and participation. YOU ARE FURTHER NOTIFIED that any person desiring to state a position on this Application may file a written comment in support or opposition with the Commission within twenty-one (21) days from the service date of this Notice. The comment must contain a statement of reasons supporting the comment. Persons desiring a hearing must specifically request a hearing in their written comments. YOU ARE FURTHER NOTIFIED that if no written comments or protests are received within the time limit set, the Commission will consider this matter on its merits and enter its Order without a formal hearing. If written comments are received within the time limit set, the Commission will consider them and, in its discretion, may set the same for formal hearing. NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO. 30149 YOU ARE FURTHER NOTIFIED that the Application, supporting workpapers testimonies and exhibits have been filed with the Commission and are available for public inspection during regular business hours at the Commission offices. The Application and testimonies are also available on the Commission s Website at www.puc.idaho.gov under the File Room" icon and then "Electric Cases. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission s jurisdiction under Title 61 of the Idaho Code and specifically Idaho Code ~ 61-307. The Commission may enter any final Order consistent with its authority under Title 61. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will . be conducted pursuant to the Commission s Rules of Procedure, IDAPA 31.01.01.000 et seq. Idaho Power requested a Commission Order on its Application by December 15 2006, but included with its Application revised tariffs showing an effective date of October 18 2006. Due to the complexity of this case and other constraints upon the Commission s time, the Commission finds that it cannot adequately review Idaho Power s request to revise its Irrigation Peak Rewards program before the proposed October 18 , 2006 effective date. Pursuant to Idaho Code ~ 61-623, the Commission hereby suspends the proposed revisions to Schedule 23 until such time as the Commission enters its Order accepting, rejecting or modifying the proposed rates in this matter. The Commission anticipates issuing an Order no later than December 15 2006. ORDER IT IS HEREBY ORDERED that the Application of Idaho Power Company be processed by Modified Procedure, IDAPA 31.01.01.201-204. Persons interested in submitting written comments in this matter must do so no later than 21 days from the service date of this Order. IT IS FURTHER ORDERED that Idaho Power Company s proposed effective date to revise its Irrigation Peak Rewards program is suspended until such time the Commission enters an Order accepting, rejecting or modifying the request in this matter.
