NOTICE OF CLOSED HEARING
On April 14, 2006, Idaho Power Company filed an Application with the Commission
seeking a Certificate of Public Convenience and Necessity for the construction of the Evander
Andrews Power Plant. The Industrial Customers of Idaho Power (ICIP) and Mountain View
Power, Inc. were granted intervention, Order Nos. 30057, 30058; however, Mountain View
Power subsequently withdrew as a party. Order No. 30113. This matter is currently set for
hearing on November 20-2006, with a deadline for prefile testimony on October 2 2006, and
a rebuttal deadline of November 6, 2006.
On September 22, 2006, the Commission received a Motion from ICIP seeking to
compel Idaho Power to fully and completely respond to five confidential production requests.
ICIP also seeks expedited relief on shortened notice pursuant to Rule 256. IDAP A 31.01.01.256.
On September 22, 2006, the Commission also received a letter/motion from Heinz Frozen Food
Company entitled Motion to Protect Trade Secret and Confidential Information of a Non-Party.
The parties (Idaho Power, ICIP, and Commission Staff) have agreed to a hearing
addressing this matter on Tuesday, September 26 2006, at 10:00 a.

the Motion(s) of ICIP and Heinz. This hearing will be a closed hearing with a sealed record
because the subject matter involves confidential and claimed confidential and/or trade secret
information. Idaho Code ~ 9-341D; Rule 287.
