IPC-06- On April 14, 2006, Idaho Power Company filed an Application with the Commission seeking a Certificate of Public Convenience and Necessity for the construction of the Evander Andrews Power Plant. On May 9, 2006, the Commission issued a notice of the Company Application and set an intervention deadline of May 18 , 2006. The Industrial Customers of Idaho Power (ICIP) and Mountain View Power, Inc. each petitioned for intervention, which was granted. Order Nos. 30057 and 30058, respectively. The Commission Secretary issued a Notice of Parties on June 16 2006. On July 26, 2006, Mountain View Power filed a Motion to Withdraw as a party and requested that it be reclassified as an interested person pursuant to Rule 39. IDAPA 31.01.01.039. Mountain View Power also requested that it be provided with copies of all Commission Orders and non-confidential testimony and exhibits that are filed by the parties this matter. No party has filed any objection to the withdrawal of Mountain View Power. This matter is currently set for hearing on November 20-2006. DISCUSSION We find, based upon the file and record herein, as well as the lack of objection by any party, that the request of Mountain View Power to withdraw as a party and be reclassified as an interested person under Rule 39 should be granted. Although a classification as "interested person" pursuant to Rule 39 would not necessarily entitle Mountain View Power to be provided with Orders or non-confidential testimony and exhibits, we find this request reasonable in light of their prior status as a party. ORDER IT IS HEREBY ORDERED that Mountain View Power, Inc.s Motion to Withdraw as a party is granted. The Commission Secretary shall provide copies of all Commission Orders and the remaining parties shall provide copies of any non-confidential testimony and exhibits that they may file to Mountain View Power, Inc.
