IPC-06- APPROVAL OF AN ENERGY SALES AGREEMENT FOR THE SALE AND NOTICE OF APPLICATION PURCHASE OF ELECTRIC ENERGY BETWEEN IDAHO POWER COMPANY NOTICE OF MODIFIED AND CO-GEN CO, LLC PROCEDURE ORDER NO. 29970 On January 26, 2006, Idaho Power Company (Idaho Power; Company) filed an Application with the Idaho Public Utilities Commission (Commission) requesting approval of an Energy Sales Agreement (Agreement) between Idaho Power and Co-Gen Co, LLC dated December 29, 2005. NOTICE OF APPLICATION According to the Application, Co-Gen owns, operates and maintains a 10 MW nameplate capacity wood waste (biomass) generation unit that is located adjacent to the Prairie Wood Products Mill in Prairie City, Grant County, Oregon (the "Facility ). The Facility is a qualified small power production facility under the applicable provisions of the Public Utility Regulatory Policies Act of 1978 ("PURP A" Under the terms of the Agreement, Co-Gen has elected to enter into the Agreement with Idaho Power for a one-year term. Co-Gen further elected to receive payments from the Company computed in accordance with the Gas Market Method set out in the Company Oregon Tariff No. E-, Schedule 85 , dated August 11 , 2005 or its successor schedule as approved by the Oregon Public Utilities Commission, as shown on Exhibits 1 and 2 to the Application. NOTICE OF MODIFIED PROCEDURE YOU ARE HEREBY NOTIFIED that the Commission has reviewed the filings of record in Case No. IPC-06-2. The Commission has preliminarily found that the public interest in this matter may not require a hearing to consider the issues presented and that issues raised by NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO. 29970 the Company s filing may be processed under Modified Procedure, i.e., by written submission rather than by hearing. Commission s Rules of Procedure, IDAPA 31.01.01.201-204. YOU ARE FURTHER NOTIFIED that the deadline for filing written comments or protests with respect to Idaho Power s Application and the use of Modified Procedure in Case No. IPC-06-2 is twenty-one (21) days from the service date of this Order. YOU ARE FURTHER NOTIFIED that written comments concerning Case No. IPC-06-2 should be mailed to the Commission and the Company at the addresses reflected below. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission s jurisdiction under Title 61 of the Idaho Code. The Commission may enter any final Order consistent with its authority under Title 61. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission s Rules of Procedure, IDAP A 31.01.01.000 et seq. ORDER IT IS HERBY ORDERED that this case be processed under Modified Procedure. Persons interested in submitting written comments regarding this case or protesting the use Modified Procedure should do so no later than 21 days from the service date of this Order.
