CASE NO. IPC-05- 1'1 APPLICATION COMES NOW , Idaho Power Company ("Idaho Power" or the "Company and in accordance with RP 052 hereby applies for an order authorizing the Company to increase its rates and charges for electric service to comply with the Commission s Order No. 29601 in which the Commission directed the Company to utilize statutory tax rates to determine the Company s revenue requirement. In support of this Application , the Company states as follows: APPLICATION , Page Backgmund In Case No. IPC-03-, Idaho Power s last general rate case , in Order No. 29505 issued May 25, 2004 , the Commission directed the Company to calculate its income tax expense using a five-year average of historic income tax expense ratios ("five-year average income tax rates Subsequently, Idaho Power, Commission Staff and other Intervenors entered into a stipulation in which the parties agreed that Order No. 29505 should be modified to utilize statutory income tax rates rather than the five-year average income tax rates to compute test-year income tax expense ("the Stipulation ). The Stipulation provides that on a normalized basis , this change to the statutory rates would increase Idaho Power s Idaho jurisdictional test-year revenue requirement by $11 504 677. The Stipulation further provides that during the period June 1 2004 through May 31 2005, the Company would compute and record monthly, based on an incremental rate of $0.92209 per MWh , in a regulatory asset account, an amount equal to the additional revenue the Company would have received through its energy rates if its revenue requirement had been determined using the statutory income tax rates rather than the five-year average income tax rates. The Stipulation provides that this deferral balance, plus interest at the PCA interest rate, would be recovered during the period from June 1 , 2005 through May 31 , 2006. At the time of this filing, the deferral balance as of May 31 , 2005 , including interest, is estimated to be $11 638,229. Finally, the parties agreed in the Stipulation that in addition to the recovery of the deferred $11 638 229 amount for the June 1 2004 through May 31 2005 period described in Paragraph 3 above ("one-year recovery"), $11 504 677 will be APPLICATION, Page 2 included in the Company s base rates for ongoing recovery after June 1 , 2005 ("ongoing recovery ) . In Order No. 29601 the Commission ordered that the Stipulation would be accepted as proposed by the Parties without modification. II. Attachment 1 , included herewith and made a part hereof, is a copy of Applicant's IPUC No. 26, Tariff No.1 01 , containing the present electric rate schedules and electric service regulations under which electric service is currently rendered and charges made to Applicant's customers in the state of Idaho. Attachment 2 , included herewith and made a part hereof, is a copy of Applicant's proposed electric rate schedules and electric service regulations , I PUC No. 27, Tariff No.1 01 , covering the rendering of electric service and charges to be made to Applicant's customers in the state of Idaho on and after June 1 2005. Attachment 2 shows the cumulative effect of the one-year recovery and the ongoing recovery. After May 31 2006, the Company will cease collecting the one-year recovery portion. This Application, together with Attachments 1 and 2, is filed with this Commission to be kept open for public inspection as required by law, and the same fully states the changes to be made in the schedules , regulations and contract rates now in force to comply with Order No. 29601. The new electric rate schedules and electric service regulations in Attachment 2 will become effective as Applicant's IPUC No. 27 Tariff No.1 01 , for service rendered on and after June 1 , 2005, unless otherwise ordered In the stipulation the parties also agreed that Idaho Power will not seek to recover in its revenue requirement any deficiency assessed by the IRS related to the one-time adjustment associated with the capitalized overhead cost tax method change for the years 1987 through 2000. APPLICATION , Page 3 by this Commission, and when effective, will supersede and cancel the electric rate schedules in Attachment 1 now in effect. III. Simultaneously with the filing of this Application , Applicant has filed its direct case consisting of the testimony of Idaho Power witness John R. Gale , together with Exhibits 1 through 7, which more fully describe the relief requested by the Company. IV. It is in the public interest that this Commission allow Applicant to increase its revenues by approving the rates set out in Attachment 2 and that said rates be allowed to go into effect as filed for electric service rendered on and after June 1 2005, and that the effective date of said rates not be suspended. This Application has been and will be brought to the attention of Applicant's affected customers by means of news releases in the newspapers of general circulation in the areas served by Applicant, by a direct mailing, and in some instances, by means of personal contact with some customers. In addition, the proposed electric rate schedules will be kept open for public inspection at all of Applicant's offices in the state of Idaho. The above-described procedures are deemed by Applicant to satisfy the Rules of Practice and Procedure of this Commission, and Applicant will, in the alternative , bring said Application to the attention of Applicant's affected customers through any other means directed by the Commission. No. 27 Tariff No. 101 First Revised Sheet No. 1- Cancels Oriqinal Sheet No. 1- SCHEDULE RESIDENTIAL SERVICE (Continued) RESIDENTIAL SPACE HEATING All space heating equipment to be served by the Company s system shall be single phase equipment approved by Underwriters' Laboratories , Inc., and the equipment and its installation shall conform to all National , State and Municipal Codes and to the following: Individual resistance-type units for space heating larger than 1 650 watts shall be designed to operate at 240 or 208 volts, and no single unit shall be larger than 6 kW. Heating units of two kWor larger shall be controlled by approved thermostatic devices. When a group of heating units, with a total capacity of more than 6 kW, is to be actuated by a single thermostat, the controlling switch shall be so designed that not more than 6 kW can be switched on or off at anyone time. Supplemental resistance- type heaters, that may be used with a heat exchanger, shall comply with the specifications listed above for such units. SUMMER AND NON-SUMMER SEASONS The summer season begins on June 1 of each year and ends on August 31 of each year. The non-summer season begins on September 1 of each year and ends on May 31 of each year. Deposit.A deposit payment for irrigation Customers is required under the following conditions: Existinq Customers a. Tier Deposit.Customers who have two or more reminder notices for nonpayment of Electric Service during a 12-month period , or who have had service terminated for non-payment , or were required to pay a Tier 2 Deposit for the previous Irrigation Season , will be required to pay a Tier 1 Deposit, or provide a guarantee of payment from a bank or financial institution acceptable to the Company. A Tier 1 Deposit does not apply to Customers who have an outstanding balance on December 31 of over $1 000.00 (See Tier 2 Deposit). A reminder notice is issued approximately 45 days after the bill issue date if the balance owing for Electric Service totals $100 or more or approximately 105 days after the bill issue date for Customers meeting the provisions of Idaho Code 9 67-2302. Heating units of two kW or larger shall be controlled by approved thermostatic devices. GS-OOP-99-BSD-0124 AVAILABILITY This schedule is available for firm retail service of electric power and energy delivered for the operations of the Department of Energy s facilities located at the Idaho National Engineering Laboratory site , as provided in the Contract for Electric Service between the parties.
