NOTICE OF WITHDRAWAL
On March 31 , 2005, Idaho Power Company filed an Application requesting approval
of a Firm Energy Sales Agreement (Agreement) between Idaho Power and Dry Creek, LLC
dated March 29, 2005. Under the Agreement, Dry Creek would sell and Idaho Power would
purchase electric energy generated by the Broadwater Hydroelectric Project located near Toston
Montana for nine months of the year (from June through February).
On April 25, 2005, the Commission decided to submit the Application for public
comment on Modified Procedure. Order No. 29764. On May 11 , 2005 comments were
received from Montana s Department of Natural Resources and Conservation (MDNRC).
MDNRC owns, operates, maintains, and manages the Broadwater Hydroelectric Project.
MDNRC sells electricity generated at this facility to North Western Corporation via a PURP A
Q F contract.
On May 25 2005 , Idaho Power notified the Commission that Idaho Power and Dry
Creek LLC mutually agreed to rescind the Agreement and withdraw the request for approval
effective May 11 , 2005. Pursuant to Rule 68 and because there is no longer an Agreement to
consider, this case is hereby closed. See IDAP A 31.01.01.68.
