MOTION TO EXTEND THE
DEADLINE FOR CITY OF EAGLE
PREFILE TESTIMONY
COMES NOW the City of Eagle by and through it attorney of record, Susan E. Buxton
and respectfully requests that the Commission grant the City of Eagle an extension of time in
which to submit its pre-filed direct testimony in this case. In Order No. 29465 issued April 14
2004, the Commission adopted a schedule to process this case. The City of Eagle is currently
scheduled to file its pre-filed testimony on June 25 , 2004. Idaho Power s rebuttal testimony is
due August 16 with the hearing scheduled for September 9 2004. Order No. 20465 at 2.
Given the demands placed on the City in responding to Idaho Power Company s pre-filed
testimony and discovery received thus far, it seeks an extension for its pre-filed testimony from
June 25 to July 2, 2004. Counsel for the Commission staff and Idaho Power have both agreed to
the extension. The City believes it is appropriate for the Commission to amend its hearing
schedule to allow the City to file its pre-filed direct testimony on July 2, 2004.
