On February 11 , 2004, Idaho Power Company filed a complaint against the City of
Eagle requesting that the Commission authorize the utility to construct a new 138-
transmission line from the Eagle substation to a new substation in Star. Idaho Power filed its
Complaint after the City denied two Idaho Power conditional use permit (CUP) applications to
build the line through Eagle. The Complaint presents three primary issues: (1) the route of the
new transmission line through or around the City; (2) the manner of construction (i.e., via aerial
poles, underground or a combination of the two construction methods); and (3) should the City
be responsible for any additional incremental costs associated with either underground
construction or with construction over a more expensive alternate route.
Following a prehearing conference, the Commission issued Order No. 29465 in April
2004 setting this matter for hearing. With the consent of the Parties, the original filing deadline
for Idaho Power s rebuttal testimony was postponed. Now that settlement negotiations have
proved unfruitful, the Commission resets Idaho Power s prefile rebuttal testimony date and gives
notice of its intent to view the proposed area of impact prior to the public and technical hearings
scheduled for September 9, 2004.
NOTICE OF REBUTTAL TESTIMONY DEADLINE
YOU ARE HEREBY NOTIFIED that Idaho Power s prefile rebuttal testimony
deadline has been reset from the date identified in Order No. 29465. Idaho Power shall transmit
its testimony via e-mail to the Parties of Record no later than Monday, September 6, 2004.

Because September 6 is a state holiday and the Commission s offices will be closed, Idaho
Power shall file its rebuttal testimony with the Commission no later than Tuesday, September 7
2004.
NOTICE OF VIEWING
YOU ARE FURTHER NOTIFIED that in preparation for the hearings, the
Commission intends to view the proposed area of impact. The Parties may presume that the
Commission is familiar with the general layout of the existing electric system in Eagle.
ORDER
IT IS HEREBY ORDERED that Idaho Power transmit its prefile rebuttal testimony
to the Parties of Record no later than September 6, 2004. Idaho Power shall file its rebuttal
testimony with the Commission no later than September 7, 2004.
