IPC-O3- On October 16, 2003 , Idaho Power Company (Idaho Power; Company) filed an Application with the Commission for authority to increase its general rates an average of 17.7%. If approved, Company revenues would increase by nearly $86 million annually. In Order No. 29369, the Commission suspended the effective date of the proposed rates, set an intervention deadline, and scheduled a prehearing conference to address timeframes for processing this case. On November 13 2003, a prehearing conference in Case No. IPC-03-13 was held in Boise, Idaho. YOU ARE HEREBY NOTIFIED that pursuant to agreement of the parties and the Commission, the following scheduling is established in Case No. IPC-03-13. Date January 30, 2004 February 13, 2004 February 20, 2004 February 27 2004 March 12, 2004 March 19, 2004 March 29 , 2004 - April 9, 2004 April 19 2004 April 30, 2004 Action Last day for Staff and Intervenors to submit discovery requests to Idaho Power. Last day for Idaho Power to respond to Staff and Intervenor discovery requests. Deadline for Staff and Intervenors to submit pre filed direct testimony, exhibits, and workpapers. Last day for all parties to submit rebuttal discovery requests. Last day for all parties to respond to rebuttal discovery requests. Deadline for all parties to submit prefiled rebuttal testimony, exhibits, and workpapers. Evidentiary Hearing at 9:30 a.m. in the Idaho Public Utilities Commission s Hearing Room. Transcripts completed and filed with the Commission. Deadline for parties to file post-hearing briefs, if desired. YOU ARE FURTHER NOTIFIED that discovery is available in Case No. IPC-03- 13 pursuant to Commission Rules of Procedure, IDAP A 31.01.01.221-234. YOU ARE FURTHER NOTIFIED that the prepared testimony and exhibits must be served upon the Commission and all other parties as set out in the schedule above. The prepared NOTICE OF SCHEDULING testimony and exhibits must conform to the requirements of Rules 266 and 267 of the Commission s Rules of Procedure, IDAPA 31.01.01.266-.267. YOU ARE FURTHER NOTIFIED that the parties have agreed to send all prefiled testimony, petitions, motions, discovery, and all other filings with the Commission via overnight delivery to individuals listed on the Notice of Parties. As a courtesy, the parties are encouraged to send an electronic version of these documents to the e-mail addresses listed on the Notice of Parties as well. YOU ARE FURTHER NOTIFIED that the servIce addresses and the exhibit numbers assigned to each party are contained in the Notice of Parties issued November 21 , 2003. YOU ARE FURTHER NOTIFIED that to expedite discovery, the parties have agreed that workpapers must accompany prefiled testimony submitted in this case. To further expedite the proceedings in this case, the parties are encouraged to provide other parties with the information they request in a timely manner and use a protective agreement, if necessary. YOU ARE FURTHER NOTIFIED that the parties agreed to request daily transcripts to facilitate the parties' filing of post-hearing briefs. Although the parties do not object to recovery of daily transcript expenses through the Power Cost Adjustment mechanism, the Commission has not reviewed these yet-to-be-incurred expenses and does not address their recovery at this time. YOU ARE FURTHER NOTIFIED that Idaho Power s Application used a test year ending December 31 , 2003. The Application included actual test year data for 2003 through June and projected expenses for the remaining part of the year. The Company agreed to provide Staff with actual monthly financial information for July through December 2003 as it becomes available. Idaho Power expects its actual December 2003 financial information to be complete and available for Staff review by the first week of February 2004. Because actual December 2003 and year-end financial information will not be available in time for Staff to adequately incorporate any changes from the Application s projected test year into the Staff direct testimony, Idaho Power agreed to allow Staff to make supplemental filings and presentation associated with December and year-end actuals if Staff deems it necessary. YOU ARE FURTHER NOTIFIED that the parties are encouraged to meet with or without scheduling a formal prehearing conference to pursue settlement of issues, identification of issues in dispute, or to address any issues that might benefit from mutual discussion. NOTICE OF SCHEDULING YOU ARE FURTHER NOTIFIED that the Company s proposal to change its electric service schedules is subject to the Commission s approval. The Commission may approve, reject or modify the requested changes in rate schedules. The Commission may determine Idaho Power s rates and charges in an amount other than proposed by the Company and/or the spread or allocation or relative increase or decrease in any rate or charge may be other than that proposed by the Company. The rates, charges, practices and tariffs of all customers of Idaho Power in Idaho, including those governed by special contract, are at issue and subject to change in this proceeding. YOU ARE FURTHER NOTIFIED that the Company has filed the direct testimony of its witnesses along with their exhibits and workpapers. These documents are on file with the Commission Secretary at the Commission s office where they may be reviewed as a matter of public record during regular business hours. The Company s proposed schedules of rates and charges will also be kept open for public inspection at its offices in the State of Idaho. Interested persons may also view Idaho Power s Application at the websites of the Commission www.puc.state.id.) and the Company (www.idahopower.com YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission s jurisdiction under Title 61 of the Idaho Code and that the Commission may enter any final Order consistent with its authority under Title 61.All proceedings in this matter will be conducted pursuant to the Commission s Rules of Procedure IDAP A 31.01.01.000 et seq. YOU ARE FURTHER NOTIFIED that all hearings and prehearing conferences in this matter will be held in facilities meeting the accessibility requirements of the Americans with Disabilities Act (ADA). Persons needing the help of a sign language interpreter or other assistance in order to participate in or to understand testimony and argument at a public hearing may ask the Commission to provide a sign language interpreter or other assistance at the hearing.
