Idaho Power Company General Rate Case
Dear President Kjellander and Members of the Commission:
You will recall that on March 30, 2004, during the Commission s hearing on the above-referenced
matter, Idaho Power witness, Bill A vera, testified concerning the prevalence of states that permit a
regulated utility to recover 100% of its wholesale power costs and fuel expenses from its customers. In
support of his testimony, Mr. Avera referenced the February 28, 2001 edition of "Regulatory Focus " a
publication of Regulatory Research Associates, Inc. ("RRA"). The Commission requested a copy of that
study. During the hearing, Idaho Power advised the Commission that the Company was no longer a
member of RRA and, without permission from RRA, was concerned that it could not lawfully copy and
distribute the article to the Commission and other interested parties in this case.
subsequent conversation with RRA representatives confirmed that Idaho Power would
unable to distribute a copy ofthat document (and an update thereto) unless the Company joined RRA. The
Company does not intend to renew its membership in this organization. Furthermore, RRA is unwilling to
grant a non-client any authority to use the February 29, 2001 document and the subsequent update to that
document. As a result, Idaho Power is unable to provide this information to the Commission for its
consideration.
