Filing of Staff and Intervenors' Direct Testimony
on February 20 , 2004
The Commission s scheduling order in this case provides that all prefiled
testimony and other filings must be served by overnight delivery. Staff's and
intervenors' direct testimony is due on Friday, February 20. We all have a very short
time after that date (February 27 - another Friday) to prepare and serve our respective
discovery requests. As a result, Idaho Power suggests that any parties that intend to
arrange for overnight delivery of their testimony and exhibits to arrive on Saturday,
February 21 , notify the other parties beforehand so that we can make arrangements to
be sure that Saturday deliveries can be accommodated. Saturday deliveries usually
involve a substantial additional charge to the sender.

Obviously, a preferable solution would be for Staff and Intervenors to
deliver a copy of their respective filings to the other parties on Friday, February 20. The
best solution would be an agreement among all of the parties that all filings must be in
the hands of the other parties on the service date specified in the scheduling order.
you concur with this latter suggestion , send me an e-mail expressing your concurrence
and if there is sufficient agreement , I will initiate an agreement for signature.
Unless I am advised otherwise , I will assume that the Staff and
Intervenors intend to deliver their direct testimony, exhibits and workpapers to the
Company by 5:00 p.m. on Friday, February 20, thereby avoiding the substantial
additional cost for Saturday delivery.
