Re:Property Sale of Idaho Power s Surplus Buildings
Dear Mr. Kjellander:
Idaho Power is in the process of disposing of three buildings which the
CompCiny: no longer uses in its, utility operation, i.e., the Homedale Operations Center
Building; the Cambridge Operations Center Building; and the Homedale Office
Building. The Company does not believe that the sale of these buildings falls within
the provisions of 9 61-328, Idaho Code , which requires Commission approval before
Idaho Power can sell property used in the generation, transmission , distribution or
supply of electric power and energy.
For your convenience, I have attached a copy of a letter concerning the
sale of the Idaho Power legal building the Company received from Ms. Marsha Smith
when she was Presidentof-the Idaho Public Utilities Commission.

our opIIDon that an office buIlding IS not property used In the generatIon
trans"rnission, distribution or s~pply of electric power and energy and is therefore
outside the scope of Idaho Code ~ 61-328 , which requires the Commission
approval before an electric utility s sale of property used in' the generation
transmission, distribution or supply of electric power and energy. Accordingly,
Idaho Power may sell the building without the Commission s prior approval
under Idaho Code ~ 61-328, subject, of course, to appropriate accounting and
ratemaking treatment after the sale is consummated.
