On August 26, 2002, Mary Burke filed a formal complaint against Idaho Power Company
regarding her bill for electric utility service obtained from the Company. On January 30, 2002, Idaho
Power notified the Commission by letter that it was no longer seeking collection of the disputed bilL
BACKGROUND
Mary Burke alleged that Idaho Power improperly billed her for electric service at a
residence from January 10 until March 25, 2002 that she did not reside at during that time. Idaho
Power contended that the bill for this period was $323., with additional late fees. Ms. Burke
disagreed.
On January 30, 2003, Idaho Power s counsel filed a letter with the Commission notifying
it that Randy E. Burke, Mary Burke s husband, had filed a bankruptcy petition on November 12
2002 and pending the outcome of that case the Company would not seek collection of the amount in
dispute with Ms. Burke for the time period between January 10 until March 25 2002. Mary and
Randy Burke have a joint residential account with Idaho Power.
STAFF RECOMMENDATION
Based on Idaho Power s representation Staff recommended that the Commission dismiss
Mary Burke s Complaint without prejudice. Staff also contacted Mary Burke regarding Idaho
Power s decision to abandon collection of the bill incurred between the above dates. Ms. Burke
represented to the Staff that she had no objection to the dismissal of her complaint without prejudice.
ORDER NO. 29223
COMMISSION DECISION
Based on Idaho Power s representation, Staff's recommendation and Ms. Burke s consent
the Commission shall dismiss her complaint regarding the disputed bill for electric service she was
alleged to have received between January 10 until March 25 2002, without prejudice.
ORDER
IT IS HEREBY ORDERED that Mary Burke s Complaint is dismissed without
prejudice.
THIS IS A FINAL ORDER. Any person interested in this Order (or in issues finally
decided by this Order) or in interlocutory Orders previously issued in this Case No. IPC-02-11 may
petition for reconsideration within twenty-one (21) days ofthe service date ofthis Order with regard
to any matter decided in this Order or in interlocutory Orders previously issued in this case. Within
seven (7) days after any person has petitioned for reconsideration, any other person may cross-
petition for reconsideration. See Idaho Code 99 61-626 and 62-619.
